FLR(M) after main in person ILR

Hi CR001

I AM APPLYING FOR MY ILR AT PEO ON 18TH April 2015. Assuming I will get my ILR same day. Then I'm planning to switch for my wife's PBS dependent to FLR (m) by post. her visa will expire on 15th may 2015 and till then she will completes only 1.5 years. So, can I apply for my daughter's MN1 after my wife visa extention or shall I have to do daughter's first and then apply by post for my wife as you suggested to dr_sea. Your suggestion will be highly appreciated

If your daughter is UK born, you can apply for MN1 at any point with you having ILR. Either before wife extension or after. Use NCS for daughter so you have your original documents for your wifes postal extension.

It is your choice. Flr(m) will reset her clock for ILR and she will have to wait another 5 years for ILR (with one extension of flr m after 2.5 years following initial visa)

As already mentioned, you can apply for your daughter at any time.

Many thanks for answering my daughter's query. I'm clear about it now. However, do I need NCS for my wife documents. As it's not clear to me (Use NCS for daughter so you have your original documents for your wifes postal extension)

Could you please answer regarding my wife's query. As preveiously I was thinking to go for another PBS dependent extention. But since it will give extension only for 3 years. so for ILR there will be short again for 7 months. This is why when I read the thread of Ramkai24814 I decided it would be better to switch to FLR (M). Could you please suggest me which would be the best option to for.

Use NCS for your daughter because you will need your original documents for your wifes application. NCS is not for your wife. You can use premium service for your wife, in either visa category.

Not surw if HO would issue your wife a pbs ext to cover the period needed to make up 5 years. Perhaps one of the other mods can advise.

It is up to you which visa to apply for. FLR(M) is cheaper but there will need to be another FLR(M) extension after the first 2.5 years visa. You need to meet the financial requirement, your wife needs to meet English A1 and there is the health surcharge too.

MANY THANKS AGAIN. that's so clear now.

As I have already took my appointment for my ILR on 18th. So, is it possible to take another appointment for my wife after a week at PEO for premium services within so short time left. Yes I'm really in confused about the length of time HO will extend for my wife. Is there any one who got extension more then 3 years or required the time for balancing 5 years in the case of PBS dependent extension?

Yes, if there are appointments available for whichever category you choose, either on the 18th after your appointment time or a week or so later, you can apply for her in person.

Thanks a lot for your valuable response. I been through all the post but didn't find anyone who got more then 3 years PBS extension for balancing the required years for ILR. I just been through all the requirements of FLR (M). As you mentioned about Financial requirements. Yes, I met the Financial requirements for this. however, still confused about child. In this catagory shall I have to mention my child. And also in the next extension shall I have to meet the same financial requirements. Could you please clarify this

As your child is not yet British, it is likely that she will be included in the financial calculation. You could of course argue the point that she is entitled to register as BC due to being born in the UK, but you can only do that once you have ILR. Child should be mentioned in the form but not for visa issue purposes, which uou can explain.

For the FLR(M) in future and for your wifes ILR after that, the same requirements will need to be met gor each stage (except where your vhild is British in terms of financial req).

Thanks a million CR001. All my confusion cleared now and I think it's best for me to go for PBS dependent extension which is so easy and yes it will cost me more. Also there is a chance that HO might extend her for 3.7 months one never knows.Once again thank you so much. I might ask you some more questions regarding PBS dependent extension form as it has been changed and there are some confused questions. I would go through with the form and if necessary could you please answer my query. And shall I post here or in a new thread.

I HAVE ONE QUERY ABOUT TRAVEL TO INDIA BUT DON'T KNOW IS IT THE RIGHT PLACE TO POST. COULD YOU PLEASE GUIDE ME THE RIGHT DIRECTION BUT I'M SURE YOU CAN SUGGEST ME.

Just for future posting, writing in capitals is the same as shouting as is also difficult to read.

1. You only surrender indian passport once you are a British citizen. You can travel on it with ILR without any problems.

2. Agree

3. I am not very familiar with indian rules but would imagine you would need either OCI or a indian visit visa for her and i am not sure if you have enough time for all the relevant processes. British citizenship can take a couple of weeks to a few months. Child passport can take 1 wee up to a few weeks, especially in the summer months. Hi CR001,

just found in the PBS dependence guidence version 04/2015 that the leave will be only 3 years.

Periods of grant
30.
We will grant leave in line with the expiry date of the PBS migrant’s (or main applicant’s) leave,
except where the PBS migrant has been granted indefinite leave to remain. In these cases, we
will grant you a period of three years leave. An application for further leave may then be made if
required to take you up to the applicable qualifying period for indefinite leave to remain.


So, in my wife case she will get 3 years extension that means need to do one more extension after that as well which will cost me 2393 for this time and God knows how much they will increase in next two years time!! :cry:

she is here for 1.5 years that means she will get ILR after another 3.5 years. so for 5 months I have to pay huge amount. :cry: :cry:

Family members of a Tier 1 PBS migrant applying in the United Kingdom must make their PBS
(Dependants) application using the paper application form.


I would like to apply for my wife through post. so could you confirm me the following please.
1) so does this mean I have to print the form and fill up and send by post in the right address given.
2) that means I do not need to go online and fill the form and then print.
3) is this the right form:

The passport you send as evidence of the parents nationality for MN1 Is usually copies.

I have never sent an original for a postal MN1.

You simply take back and forward copies of the settled parent's passport, and it will be granted.
