FLR (M) Approved/Rejected for Tier 1 dependents

My Visa Status : I got my ILR on March 2015 under 5 year route (Tier 1 General 3 + 2 Years) and applied extension for my wife and daughter via FLR (M) on same date by post. I received my BI card after a week after because I got ILR through premium service and once I received it I send that to UKVI as a supporting document of the FLR (M) application.

Why I applied via FLR (M) : It was a obvious choice for me and I did made few calls UKVI to confirm that before making the application, explaining my situation and they do confirm that FLR (M) is the right category.

Our Current Status: It's 12th weeks running which is more than the standard 08 weeks so called UKVI and response was the application is "In Process". During this conversation UKVI executive also told me that I have applied in wrong category for my Wife and daughter (born in India) as they were before on Tier 1 Dependent from last 1.5 years and they should extend in the same category untill they complete their 5 years. After having this phone conversation I read exceptions to FLR (M) and she was correct but at the end of call she gave me a little hope that since its FLR (Marriage) it may be considered.

I know I should have read that exception before AND THE UKVI EXECUTIVES should also given me correct information.

Please advice if anyone's FLR (M) application has been considered/approved under my scenario. And also please advice if it gets rejected can I appeal before reapplying?

Why did you apply FLR(M) for your dependents? This will reset their clock for ILR to zero and they will have to wait another 5 years from FLR(M) visa grant before applying for ILR. They could have extended on Tier 1 Gen dep.

How long have your dependents been in the UK and on what visas?

My dependents were on Tier 1 dependent for 1 year 4 months so under Tier 1 extension as well they will need two extensions.

Please advice if they will consider our FLR (M) application as we don't have any problem if the 5 years clock gets reset to zero.

I am just concerned if they will refuse it (as per the exceptions in guidelines of FLR(M)) and I will loose my money plus have to apply it again with the increased fees of Tier 1 dependent

It should be fine if all the requirements are met. Many applicants have done this switch as FLR(M) is cheaper.
