FLR(FP) instead of FLR(M) for spouse- pls Help

Post by abc2zeed » Mon Jan 25, 2016 10:36 pm

Dear members of this great forum, Someone mentioned this forum to me, and indeed it is great to be here. Pls forgive me if I post in a wrong section as I am a bit confused. My story:
I am presently on ILR(PR) obtained last October after 10yrs lawful residence. My dependants (wife+3children) are here. Wife +1st child are still on Tier1 General and the remaining 2children are UK-born and already have UK Passports.
Ideally, my Tier1G dependants should change to FLR(M) after my status changed to 'settled', but it appears I could not meet the criteria. . So I thought of only option left as a Discretionary Leave FLR(FP). My spouse has passed the basic A1. But I began to be afraid as I started completing the form, probably FLR(FP) is not the right choice. Certainly I need advice. Please help, what are my options? Their Leave to Remain runs out in May. Kindly help

Which criterion do you or your spouse not meet?

FLR(FP) will lead to her and your eldest child getting ILR under the 10 years Long Residence criteria themselves. How many years have they spent in the UK already?
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.

Thanks @Simon. Financial criterion. Also when I read through the loads of other criteria and documents requested, I nearly fainted. That's why I'm thinking of alternative means. My wife+eldest child have been in UK 30months (2 1/2yrs)

What loads of criteria? It is financial requirement and wife needs English A1.

Documents is 2 years cohab documents, roughly a couple of items every 3 or 4 months either in joint names or individual names.

Financial requirement is £22,400pa and can be joint income or only your or only your wifes.

Thank you very much CR001 for alleviating my fears. Based on https://www.gov.uk/government/uploads/s ... t_2015.pdf, Cant my wife apply for Family Life (as a Partner or Parent): 5-Year Routes, using FLR(FP)? According to page 7 of the above doc which states that the rules "apply to partners of Relevant PBS Migrants who are applying under Appendix FM for leave to remain in the UK, whose partner has been granted indefinite leave to remain under the long residence provisions of the Immigration Rules. ? I am of the opinion that rules are less stringently followed under this route
