FLR(FP) Parents Route problem

Post by ROHAAN7 » Wed Dec 12, 2018 10:55 am

Hello All respected modtrs.
I have been visiting on this forum from last couple of years and believe me this gave me loads of confidence specially whenever I submit my application it gave me chance to ask all logical and relevant questions to my solicitors. But after nearly 6 years finnaly I am stuck badly and i need your help please.. I am not sure weather I made correct decission or not. Please find below my end to end case history.

1: Came to UK on student visa in 2011.
2: Got married with EEA national in nov 2012 and granted residence card in may 2013.
3: relationship didn't work out so got divorced on 2016.
4: Apply for Retain Rights of Residence and successfully granted in 2017.
5: Apply for PR in 2018 and successfully granted.

After divorce I met with a girl who came into this country on Visit Visa we had relationship and God blessed us beautiful child. I applied for neuturlization for him and successfully granted and British passport was issued to my son.
this is the turning point, Unfortunately our relationship didn't work as we hope but I cannot even live without my son no way he is meant to my whole world. this is a reason I am supporting my child's mother fully and I really want her to stay in this country for sake of my son. I been full time employee for last 7 years never claim any benefits ever no adverse immigration history never live a single day in this country as over stayer no criminal record and same with my child's mother. I applied for her FLR(FP) parents route.
despite the fact that parents route application only consider if both parents living separately. In my case may be I made mistake coz my my child mother also living in same property the reason I state in letter that she have visit visa and it is very hard to arrange accomodation for her and i don't want my son compromising with such things. I state in letter I am fully supporting Financially, morally, also providing shelter etc. etc. I also mention like if the home office grant her permission she can start employment as well and can get settles as she already had offer of employment.

Now I need to ask all respected peoples who are here just help peoples like me and always guide wisely could you please tell is there any chance application can be successful?
She applied on 6th dec 2018
fee deducted 7th dec-2018
we received our son passport on 10 dec-2018 .
I am very confused please if someone can shed some light on this ...??? Shall be very thankful.

I don't understand how this woman (your former girlfriend) is here on a valid visitor visa? To meet you, become pregnant and you've already applied for a passport for the child? That would take a minimum of 10 months?

Was the birth paid for?

To be honest, she stands a better chance (and FLR FP are never guaranteed) if she is an overstayer as her leave is not extant. No one can reassure you, because, as I said, there are absolutely no guarantees with this type of visa (essentially applying outside the rules). There are a few reasons they could approve and some why they may reject the application. It seems to be a bit pot luck.

Hi physic skate,
Thank you very much for your response I really do appreciate that.
Well first of all I would like to tell you she got 5 years Visit Visa and after my divorce just beginning of our relationship she normally stay 2,3, months and leave the country but on her last trip when it came to know she is heavily pregnant we decide she should stay here so since 2016 she overstayed on her visa.
The second thing about NHS, yes the birth was paid almost 30% paid and rest of paying by payment plan which agreed with hospital all those standing order documents were also attached with application.
