Asylum Claim. Help

Dear All,

Thanks for the job that you do and all the time spent here on this forum.

I do not know if this is the right part of the forum but I will write here for now. I am from Ukraine and I have been living in the country for 10 years so far with my wife and my under 18 ( now under 18 son )
I have applied for ASYLUM in the UK with my family ( Husband ( myself ) and wife and son and we have been waiting for the decision for 22 months until. now and no answer yet has been received.
I was granted temporary permission to stay ( WITHOUT THE RIGHT to work - WHICH IS REALLY FRUSTRATING ..... I want to work and I do not want to apply for any help from anywhere and anyone -NO BENEFITS needed ).

Would anyone know about the time scale on the taking the decisions of my type? MAYBE SOMEONE KNOWS or has more INFO as he / she applied on the same grounds.
Also could I refer my case to somewhere else ? ( Maybe speed up process or at least to be given permission to work for me and my wife ( our son is old enough )

Please help me of you can and maybe someone had similar case or similar situation and they know more about the the time frames of such applications and if I can get the work permit somehow ??

I am no expert on asylum applications or the whole process, and I'm sorry this causes you much difficulty.
You will be aware that the topic of asylum is very high on the political agenda, and the government touch it only when they need to cheer up the electorate. Subjects like work, work permits, accommodation are hotly contested in the political arena. Trying to get a general work permit or getting some third party to progress your case will be extremely difficult. Even if you don't want benefits, etc.
These are my personal views here. I hope you will get this sorted, however I would think there would be very few members here with either good knowledge of the process or even direct experience. Have you tried to find/get in touch with Ukrainian Support Groups in your area? They likely have some contacts for immigration issues.

On what basis have you been living in the UK for 10 years? What is your immigration history?

If you have been living in the UK for 10 years, why have you only applied for asylum less than 2 years ago? On what basis have you claimed asylum?

In such a moment I really need at least some positive word.



1) On what basis have you been living in the UK for 10 years? What is your immigration history?

I have arrived on tourist visa with the whole of my family ( I lived in Ukraine in the region bordering to Russia)
when the war has started ( and it has started in 2014 - 10 years ago ). Nobody has treated that as war, unfortunately and for some reason as internal conflict ( which Russia was stating since 2014 )

I have arrived and stayed in the country illegally - I must admit and my wife and my under age son too.
British , officials did not take the conflict of 2014 that seriously as they treat it now and many people / families were deported to Ukraine ( as if there was not war in Ukraine at that time )
The immigration officer which had my last interview with me confirmed that our chances in 2014 were almost ZERO 9 ( immigration official said that and it was also recorded in my interview record )
Only then , when the Russian Federation attacked Ukraine at full scale I saw the opportunity to apply for ASYLUM


2) If you have been living in the UK for 10 years, why have you only applied for asylum less than 2 years ago? On what basis have you claimed asylum?

I have claimed asylum on the basis of local persecution by the authorities and police and fighting with corruption.

You have virtually a zero possibility of gaining asylum on the basis of your claim. Ukraine is considered a safe country similar to Eastern European countries that are members of the EU.
Your asylum claim is certainly not going to be considered as a priority given the current position in the Ukraine and will be seen as opportunistic at best.
As for the right to work, you should be able to achieve that due to the time since you claimed asylum. Ask the Home Office for permission to work.

Many people similar to me have been granted at first temporary status and later permanent one.
I have my son here who went to primary school and and now studies at secondary school.
Do you think I have chances ? And what else can be done .......
I have written several times to my local MP and he sent letters to Home office on my behalf.
Is there anything else what can be done.... ???

I am sorry to ask for it and I know some people would see as bad because I have not applied immediately.

Apply to the Home Office for the right to work as a first option.
Your asylum claim may take many more months or even years. Your current status as an overstayer and the length of time in the UK with no status gives no priority or special consideration. Pushing for an answer through your MP is not going to achieve much of anything. The Home Office has little regard to MP letters and given the circumstances of your claim it is very unlikely that the response will be meaningful.
