Covid 19 - extending visa from UK?

Post by riyan » Sun Aug 16, 2020 10:54 am

Dear all,

Thanks in advance for coming to read this and appreciate advice/ help you can give.

My parents are in the UK under visit visa (10 year visitor visa) and currently looking after my little kids, after my recent divorce. They are struggling to return back now as per their tickets due to covid 19

So I was looking to see if I can extend or if I can apply any visa from the UK and found below:
https://www.gov.uk/guidance/coronavirus ... -residents

https://www.gov.uk/settled-status-eu-ci ... ss-citizen
This link has > If you're not an EU, EEA or Swiss citizen:
you’re the primary carer of a British, EU, EEA or Swiss citizen

I'm trying to find a route to apply for at least 1 parent, from the UK - without the need to travel back
My mum looks after my 1 year old baby and if she'd travel, with quarantine going around I'm going to have serious difficulties with work. So can I apply from the UK on above category as my mum being the primary carer of my baby? Or are there any routes / what'd be the best advice please?
Thank you so much

(hopefully this will be useful to many who are relying on grandparents for childcare!)

What is your immigration status??

The settled status category you quote is not relevant to your parents. They are not the primary carer of your child, you are. The route you quote is for parents who are separated and meet the requirements under the zambrano ruling under the EEA/EU rules.

Also, providing child care while on a visitor visa is considered work. They are not permitted to do any form of work, paid or unpaid, while in the UK as a visitor.

Any long term route you attempt to apply for which will be refused, will result in future visitor visas being refused and her current visa possibly cancelled as she would be declaring with any other visa application her intention to live and work in the UK.

Thanks CR001

I'm settled and citizen, prior to my children's birth also so they are also British.
Yes I'm the primary carer but as she helps looking after children whilst I'm working, specially me being a single parent, is this route or any other route not available given the spouse who obtained visa from me is no longer here to help us?

So the only option is to travel and return - amid covid?

She shouldn't be "working" as your child minder as a visitor visa holder.
Especially me being a single parent, is this route or any other route not available given the spouse who obtained visa from me is no longer here to help us?
No, there is no route for your parents to live in the UK. The route that is available is very expensive, very difficult to get and almost guaranteed to be refused and shuts the door to any future visits.
So the only option is to travel and return - amid covid?
Yes.

How long have they been in the UK on their current visit?

When does their visa expire?
