IHS Refund pending from 8 months

Hello everyone,

I made a dependant application for my wife in January, I paid IHS on 7th but submitted my application a little later with in January. By 20th January I got appointment ready in hand!

As mentioned in my previous post, I've paid £1200 IHS fee on 7th Jan for 6 years, according to the date I've paid it was still within the old fee structure (£200 per year). We received our visa and everything (with a little hiccup due to wrong fee as explained here ), but haven't received the remaining IHS fee even now!!

We've been chasing them from then (sent letter, emails, phone calls) but every time we speak to people who just say we are escalating! out of n number of escalations, someone called my partner on 24th Sept saying that we will not get any refund as the fee we paid is enough for 3 years as we submitted application later(12th Jan and the new fee structure started on 8th Jan) !!!!

When I was paying IHS fee, i literally paid for 6 years by the time of applying! There is no single note neither mentioning that I should apply within certain time frame to get my refund nor saying if I don't apply today they put me on new fee structure!

I don't understand why they took so long just to say this! I really felt like they are just dishonest and I want to fight this!

Has any of you gone through such situation? Can you guys suggest me a good point to start with to get my refund of £600

Any suggestions would be appreciated.

You won't get any refund because application doesn't gets completed with a mere IHS payment only. The new doubled IHS fee was applicable from 8th Jaunuary but you submitted your application after it so what's the point will you get any refund because the new ihs fee of £1200 that you had paid actually covers to 3 years correctly instead 6 years.

I understand that paying IHS doesn't simply complete an application but IHS is also part of an application!

Does it also imply, if I pay IHS fee prior to 'application fee' change (around Apr 6), will I get to pay new application fee if I apply after Apr 6 or I can use old fee?

I'm trying to use the above example to explain that only application fee reflect when the actual application has been submitted not IHS!?? (please correct me if I am wrong).

Also, while paying IHS it didn't mention anything when I need to submit my application or any rules stating that new fee will apply if I submit it after 8th Jan!

While paying, the request was for 6 years and only got 3 years based on the rules, though my partner will be eligible for ILR with in 12 months time.

I had other people who did exactly the same, whom got the refund as expected and for the people who paid for 3 years only (£600) didn't get charged for another £600 though their application was received after 8th Jan! I think this is unfair on us!

To avail the opportunity to come under old IHS criteria you should have submitted the whole application before 8th January. In other people's examples they must have done same as above. I m afraid but you are not eligible for any refund.

I could've, but there were some questions and concerns during application filling and understand the new process which was introduced around that time! so I had to clarify myself before submitting it.

Other people who got refund also paid IHS prior to 8th and submitted application after 8th, wondering why our application is different to them!
