ILR and Self-Employment, Do I Need A Biometric Residence Card?

Post by Funktofunky » Thu Jul 16, 2020 12:48 am

I am Canadian and I got approval for Indefinite Leave to Remain in the U.K. in 2012, then I became self-employed in 2013 (and have remained self-employed since then). Since my passport with the ILR vignette expired years ago, I’ve been carrying that passport along with my current passport every time I travel. I have never had any problems at the border (and I normally travel a couple times a year), I just show them my new and old passports and tell them what page the ILR visa vignette is on in the old one. No questions. All good.
So I’m wondering about this Biometric Residence Permit. It’s my understanding that as long as I’m self-employed I do not need the BRP, but if I want to someday be “employed”, then I’ll need to transfer my IRL visa to a BRP.

Can anyone please confirm that I don’t need a BRP if I’m self-employed on IRL? Thanks! :)

Correct. But since Immigration Act 2014 came into force, you need a valid BRP to officially prove your immigration status for employment and use of the public services. This means you need it for employment, to rent a place, to open a bank account, to use the NHS or get a driving license. I suggest to apply for one as it takes 6 months to be issued

Thank you. But actually since 2014 I’ve had 5 surgeries on the NHS, moved to a new rented place (and they took copies of my passports) and have gotten a provisional driving licence. So apparently you don’t need a BRP for all those things. I have seen that you do need it for employment though.

Correct. Ideally apply for BRP earlier than later because the process usually takes 6 months (pre-lockdown) and without it you won't be employed and many have lost their jobs or job offers in its absence. Look a recent experience about delays:
