transfer of conditions

Post by darrux » Sun Apr 04, 2004 5:34 pm

Please share your experience!
The passport that has my WP visa valid until 2007 is due to expire. I have a new passport and mail it to HO together with the old one for transfer of conditions. I was told they cannot provide any info on how long it takes to process the transfer of conditions from old passport into new one "the target is 12-13 weeks but it can't be guaranteed, could be shorter, could be longer".
Has anyone been through the same experice? Does it really take 12 weeks to stamp a new passport?
Thanks

3-13 weeks is the generic HO target time frame for processing postal applications. I suspect you will get it processed within a month. In future it is best to go to a Public Enquiry Office in person if possible and get the stamp transferred on the same day.

Thank you for your reply!
I called in today to ask for updates on progress and I was told that they do not transfer leave to remain visas, but only ILR, so I was advised to travel with old passport with visa and new valid passport together.
Is this common practice?

Travelling with an expired passport with valid visa and new passport is an avenue many have used. You would get the leave transferred to the new ppt at the Port of Entry e.g. Heathrow. I am surprised by the comment that they do not transfer leave because AFAIK that's bull. The HO is intent on introducing a charging regime for transfer of leave to remain in line with that in place for ILR - the proposal is in the current Asylum and Immigration (Treatment of Claimants etc) Bill before parliament. Perhaps they are unofficially not transfering leave until this new charging power comes in. Who did you speak to on the INEB line - many of the operators do not have a clue about immigration law as they are not caseworkers and I urge you not to be too taken in by their 'advise'.

Thank you very much for your reply! I have been transferred today by the customer service operator to a so called "specialised" person who provided the advise. It wasn't clear the full procedure and some steps of the process were unclear for the "specialised" person too ("changing", I was told!), however, I was assured that I don't need to transfer the visa. Until I sent the passports in, it took about 10 calls to the customer service and 10 times different answers and various addresses to mail them to. Nobody has mentioned ones the option of going in person to Croydon.
I was also told today it can't be processed as I haven't filled in the form which came in force as of 1 April. I sent my application before 1 April so I don't see why I should have done a new form before it came in force. Quite a mess with the procedures!

Anyway, I am considering carefuly your advise.

I hope things will be solved and as you said, next time I'll go there in person.

Many thanks again!
