My case is also very strange

Set(o) Tier 2 ILR Online submission: 10th of Dec

Biometrics appointment: 14th of Dec at Glasgow centre

Still waiting for results. I have been calling them for third times. The first email I received was a bit strange. It said that my application has not been completed and I shall keep waiting.

Several days later when I made my second escalation, the email was: We are aiming to make decision within 24hrs however if the case is delayed due to not customer fault, then I am eligible for refund blablabla (generic again).

Then something strange happened today. I did my 3rd escalation yesterday and today I got a phone call from them and they said they were unable to track my application online. Then they gave me an email address and asked me to email them my application form!

After I did that, I receive a further phone call from them and said my application has been found and there is a delay in process blablabla and I am eligible for refund (generic reply again). Then 2 hours later, my solicitor received a very strange email! It was sent by UK Sopra Streia and said: Thanks for uploading your supporting documents. We have now completed the following checks of the files that were available as of 15/1/19.

Did anyone got this email before? The strange thing is I never paid for this documents checking service and it did send to me after a month waiting.... That is very strange...

When I went to sopra steria, they just scanned my passport and said my application is submitted. But they didn't ask for any documents hard copies even though I told I had them with me. However, I had uploaded them already in my UKVCAS account beforehand.

Now it's been almost 3 weeks since 18th December. When I called home office regarding the progress, they said the record shows, my application has not yet been completed!

What does it mean? What should I do not?
Should I call sopra steria about it? I haven't contacted them until now and I haven't gotten any email from them saying my documents have been sent to home office.

Please, anyone, help me! Suggest me ...I am really very stressed. I am concerned if my visa gets rejected for incomplete application.

After 3 escaletion and contact MP, I received an email from a lady UKVI on my case yesterday, in the email she attached a letter apologising for the delay, and says my application raises 'exceptionally complex issues'. But she is unable to elaborate on what the issues are when I asked for more details.. :(

I'm very upset. I thought my case is finally moving forward but seems like it's just the same with all the previous answers I got from the phone. "We haven't made a decision, it's complicated, and we can't tell you what's going on"

I don't know what's complicated about my case...I worked continously with the same employer for the pass 5 year, and my salary reached the required level, less than 180days outside UK in the past 5 years in total. Before that I was on PSW visa.

@momozz, My scenario is same as yours, was in PSW then in tier 2 with same employer. I haven't heard anything from Home office, no phone calls nothing. During my 5 years in UK, I traveled total of 11 times so not sure if that's causing any issue in my part.

May I ask you if you ever had any issues/visa refuses in the past? (like in your Home Country when you applied for the UK visa) Obviously it is just speculation but I think "complex issues" are just an excuse they would share with an MP and the applicatnt as they need to justify the delay. Tier 2 to ILR are the most delayed cases clearly.

Did you receive an email from your caseworker? You can email him or her if so that you have not received the BRP yet. Or you can report the problem:

https://www.gov.uk/biometric-residence- ... ot-arrived

If your BRP has not arrived
You can report online that your biometric residence permit (BRP) has not arrived if:

you’ve applied from inside the UK
your ‘decision letter’ from the Home Office saying that you can remain in the UK arrived more than 10 days ago

Updates from me:

"Something for you" cards from Royal Mail and Dx: 15 January 2019
Letter/BRP collected/redelivered: 16 January 2019
Asked a couple of questions to my caseworker via email, and she replied quite quickly within 30 minutes.

Context of my application:
SET(O) under Tier 2
Online application: 1 Dec 2018
Biometric: 1 Dec 2018, Super-Priority Service at Manchester Central Library
Numerous escalations to UKVI contacts, writing to complaints & general enquiry emails, calling Sopra Steria to confirm that my application/biometrics are correctly submitted
Email decision: 11 January 2019

In my Tier 2 stay, I had 3 different employers and travelled a lot (mostly short business travels in EU though) and I don't think my application was treated as a "complicated" case at all- although I had always been mindful that I had to apply for ILR and have been filing every single detail about my Home Office and HMRC records (like Permit numbers, decision letters with case references, P60s...)

In my opinion, writing to an email to the complaints team or complain via your MP is the most effective way to put some pressure on your case.

Make sure that you've received a case number by automated email after your application submission. I received an acknowledgement email on the following working day with a case number, although it was addressing to my old names and saying the application is within 6 months' standard.

Did your approval email come from a generic home office email address? I can find my caseworker name on my approval letter as well, so maybe you can read the letter again and try to find the name? Then usually the email address is FIRSTNAME.SURNAME@homeoffice.gov.uk

No I never had any issue before. One student visa, one PSW visa and then Tier2, extented twice...I told her all the visa reference number I had so she should be able to look me up in their system.

Hello,

I am still waiting for the decision on my ILR application. I finally requested my MP to escalate my case 2 days ago and received an email from MP's office that they have escalated my case with Home office. I have also emailed to home office on their complaint email id about my case. My bio-metric appointment was on 14th December'18. It was a straight forward application through Tier 2 SET(O).

What your experience about home office complaint email id? Did anyone receive decision quickly on their application after emailing to home office? The automated reply says that home office aim to reply within 20 working days which means I will have to wait until February.

Hi momozz, it sounds like she's your caseworker or at least someone in the same team with your caseworker who has access to your records. It is however bizarre they cannot give you more elaborated answers why your application is too complicated. I believe you can politely but assertively request further information, based on the following guidance from their website? You can ask her that if we are not satisfied with the answers, you have to raise an official complaint.- at least this is what I would do.

https://www.gov.uk/government/organisat ... r-services

Super priority 24 hour service
For added value appointments at our commercial partner attended on a Saturday or Sunday, the appointment will be deemed as attended on the next working day. In most cases this will be a Monday but where there is a bank holiday it will be Tuesday. For example, a Saturday 11:30 appointment (30 minute appointment) will be deemed as attended on Monday at 11:30 and the decision completed and despatched within 24 hours.

When you apply:

our staff will be thorough and polite, and will treat you with dignity

our information will be in plain language and accurate

we will provide you with a detailed response to an enquiry

we will keep your personal details confidential and handle information about you in line with the Data Protection Act 2018 and the General Data Protection Regulation 2018 (we may need to share it with third parties but only if lawful and necessary)

Dear Pinam, I submitted on the 14th of Dec as well. Which centre did you present to? I did that at Glasgow

Hello,
That is very odd. Can you access your online Sopra account? You should have uploaded all documents there and during your appointment at Sopra they should have checked your papers (especially if you paid £35 for the checking service). Give Sopra a call and try to resolve the problem there then call the HO again and ask them to confirm that the application is now complete.

Just one question please, on what number did you reach the HO? may you share it here please?

Thanks and good luck
