Brexit does not affect applications made under the UK immigration rules, it affects EU citizens and their dependent family. Not sure why you believe it does.

I'd will like to ask on my personal behalf and others (maybe Allyf) as i have been following posts from an old thread and i have been reading the posts on here very quietly as well.

Q. Is it worth paying £3018 for the Super Priority Service, knowing what you have been through?

Brexit was only a concern. I didnt think it will affect UK applications but we live in the UK and I am sure come April 2019 (a month after brexit) visa fees will go up again. For as long as i have lived in this country, UKBA or UKVI have never frozen visa fees and who knows what impacts Brexit could have for foreign nationals such as myself and others - specifically related to immigration caps etc.

Fees increase every year in April sometimes in March. You are worrying for no reason at this stage for applications under the UK immigration rules which don't fall under the scope of Brexit or the EU.

Dear I think it is one of the best service ever introduced very easy to apply upload your document book your appointment and go for it biometric will be don on your chosen date and center very quick it’s worth paying the fee and best of all you will come back with all your original documents and passports while your application is being decided great is not it and about 90% cases are dealt within 24 hours time I highly recommend this good luck

New service is obviously better than old: easy, manageable and quick for paperwork.

In terms of decision timing, two issues with your question:

(i) At this stage, the choice of super priority or standard is a bit of luck. I was in similar situation asking this question because I have holidays booked for Christmas. I was reluctant when seeing some people reporting delays. But I then decided to take risk going ahead with super priority (from my observation, probability of delay is less than 10%) and honestly I was lucky to get it exactly what I had planned for in terms of timing. I guess most people would get all done within a week, assuming straightforward application. Note that new service has just started for more than a month so it is reasonable to see some delays. I believe after few months, new service will make what it promises for super priority.

(ii) If you have plenty of time, standard service would take you around 2-3 months. Not bad given the amount you save from super priority, especially when you have a number of dependents. But I favor super priority because it is time value of money. I really don't want to wait anxiously for 2-3 months because I can't focus on work. And more importantly, if someone goes on with citizenship, it saves 2-3 months as well.

So, decision is yours. But I like making informed decision and so always analyze things like I do above.

Clarification ( misunderstanding from my side ).

Applied for Indefinite leave to remain (SET M ).

Applied online 28/11/18

Got sopra next available appointment on
5/12/18 : 11am. Appointment finished by 12:10.
( cost £260 for the slot at premium lounge mark lane London )

My husband got a email on 5/12/18 14:30 confirming his approval for ILR ( my previous comments did state I did not receive any messages but they did not send on the new email address given on application, they used previous email on last application ).

Received letter on confirming approval on 12/12/18

Received biometric on 13/12/18.

Misunderstood the system initially on my previous comments

I had submitted my documents at the Sopra Steria centre in Croydon on 26th Nov using Super Priority. Have not heard anything yet. Have escalated it 3 times now again with no response. This is extremely frustrating.

this is regarding the comment that only 10% applications are delayed and 90% done in 24 hours.
one personnel during the phone call told me that they are getting lots and lots of phone calls regarding delays in super priority and there are issues( dont know if he said that to make me a bit calmer). i was under the impression that quite a lot of applicants were facing the same problem of delay especially around 26-28th nov time.
hearing that we are only 10% causes more worry
But now that they have asked us to wait for 4 weeks before any action puts us in the situation of patiently waiting as we cant do anything else but wait. i wondered whether they would aim to finish the pending applications before they break for chrismas , atleast.

You cannot apply for ILR on form Set M under the UK immigration rules if you hold an eea residence card for the last 5 years. You need to have held a spouse settlement visa for 5 years (2 x 2.5 years visas) to qualify for ILR on Set M. If you don't hold this visa, your application will likely be refused and you will lose your fee paid.

If you hold an EEA RC for the last 5 years, you should have applied for PR on the eea4 form, which costs £65.

Thats Interesting, as I believe at the time I ran through the wizard and since I was the partner of a EU national who is now a british Citizen, fufilled the 5 years on the same visa and It has now expired, that ILR on the 5 year route was the correct path. At least now I know if it gets rejected the next step and £65 pounds is easy to deal with. The laws keep changing especially with brexit, and I think the main concern is leaving and entering the country freely with the right to work as now I am married to a british Citizen. but EEA PR was not the clear choice at the time in my situation.
The rules have not changed at all regarding being eligible on Set M for ILR or for PR if on an EEA RC. You simply cant use set m if you don't hold the appropriate visa.

Your other risk is that Set M is refused and they offer or put you on the FLR FP 10 year partner route (4 x 2.5 year visas), this appears to be almost automatic these days.

Out of interest, did you do the LIUK test for set m?
I really wish I knew that before! 3300 pounds is no small amount of change. I did do the life in the UK test, in 3 minutes and passed as part of this procedure.

Your response has left me in a bit of a limbo at the moment, Do I wait for them to process and approve or deny, or do i Submit the paper EEA PR form with all the relevant identification and be held hostage for an almost guaranteed 6 months. It took them 4 months to process the initial RC in 2013, that was a tough year.

The 10% probability of delay is just my own calculation. Before I applied, I had noted down all the cases reported here regarding success/delay using new service super priority and simple statistics told me that around 90% got decisions/letters/BRPs within a week. If we count also people who do not report anything here (successful applicants tend not to find a place to report), the probability of delay for more than one week is less than 10%. I made decision to apply knowing that it would affect my booked travel but with a confidence that my application is a straightforward one so very likely I would be on safe side. But things have changed since then I am not sure as it seems more people reporting delays after I applied (late November).

Have HO called you again or you are waiting for the call. I had approached my MP last Friday. MP approached HO and emailed him (MP) they are doing additional checks. Well I don't know how to take that news. In my view, as per solicitor view and as per my conscience I fulfill all the requirements for Tier 2 G to ILR.What checks they are doing, I am not sure. Just waiting and hoping for best.. seems to be the option left.

Tiny update.

Reminder: SET(M) application, online form submitted Nov 12th, Sopra Steria appointment Nov 30th, I am among c.20 on these boards who have applied before the 'qualification period minus 28 days' (I've counted them!) so that adds a whole other level of anxiety to the entire process.

Re-escalated on Tuesday via the UKVI helpline. My wife got a call Wednesday afternoon, she confirmed name/DoB, etc. Woman said, wait on the line, disappeared for a minute or so, came back, said "I will need to call you back, I have to get some more information" and that was about 45 hours ago!! I think the only thing worse she could have done was to say "wait on the line" and then never come back!

We have considered ALL options

1. writing to the HO complaints email address
2. writing to our MP (who is a braying Brexiter nutcase so would probably delight in our pains)
3. doing a chargeback on the credit card fee...this would clearly be the nuclear option so don't really want to do that

as it is, we'll probably just re-escalate again on Monday, stress it's now getting urgent because my wife's FLR expires on Jan 3rd and we still have the possibility of having to re-apply. I have to say though that as all this chaos gets worse and worse, my optimism regarding the date issue is rising.

1. There have been SO MANY of them by this point, that I would find it almost inconceivable that the HO is rejecting anyone for it.

2. The HO knows they're currently in a mess, so I think they'd throw us a bone and give us the benefit of the doubt on such a technicality anyway. That's my wife's thinking anyway and I tend to go along with that.

hang in there everyone, we'll meet in a pub this time next year and laugh about it all 8) :?

Have HO called you again or you are waiting for the call. I had approached my MP last Friday. MP approached HO and emailed him (MP) they are doing additional checks. Well I don't know how to take that news. In my view, as per solicitor view and as per my conscience I fulfill all the requirements for Tier 2 G to ILR.What checks they are doing, I am not sure. Just waiting and hoping for best.. seems to be the option left.

You cannot apply for ILR on form Set M under the UK immigration rules if you hold an eea residence card for the last 5 years. You need to have held a spouse settlement visa for 5 years (2 x 2.5 years visas) to qualify for ILR on Set M. If you don't hold this visa, your application will likely be refused and you will lose your fee paid.

If you hold an EEA RC for the last 5 years, you should have applied for PR on the eea4 form, which costs £65.

Thats Interesting, as I believe at the time I ran through the wizard and since I was the partner of a EU national who is now a british Citizen, fufilled the 5 years on the same visa and It has now expired, that ILR on the 5 year route was the correct path. At least now I know if it gets rejected the next step and £65 pounds is easy to deal with. The laws keep changing especially with brexit, and I think the main concern is leaving and entering the country freely with the right to work as now I am married to a british Citizen. but EEA PR was not the clear choice at the time in my situation.

I was the unmarried partner of a EEA national, now a married partner of a British Citizen. I imagine it comes down to which rights I wish to execute, and then pathway to use after my RC expired in october 2018.
