Getting NRPF Removed From Tier 2 Visa

Hello,

I'm a US citizen on a Tier 2 work visa. I've been living in the UK for about 2 years now and am currently on a 5 year work visa. Last year, I had a child, who was born in the UK, but is an US citizen as we currently do not have ILR.

I am trying to get access to basic public funds, such as child benefit, tax credits, etc., but am unable to do so, as my visa/ BRP states that I cannot get access to public funds.

My question is, are there unique cases as to when HMRC would modify one's BRP? How would I go about applying for access to public funds given my visa status?

No, there are no unique cases for a tier 2 migrant to claim benefits. You are not entitled to claim until you hold ILR. . If you claim, you will be in breach of your visa conditions.

It is not hmrc that modifies your visa conditions, it is the home office.

Also, as a tier 2 visa holder, you would be on a fairly high salary already, which would make you ineligible for tax credits if you could claim benefits.
