I want to ask for an advice regarding the ground for our appeal.
We submitted an appeal against a decision not to issue my grandparent with a FP to come to UK. Both my parents (my dependent family members) and I (Irish national) reside in UK. We solely relied on EEA legislation (section 7) to demonstrate him to be my dependent family member. We did not claim breach of human rights and I want to ask you if we should have (and will have to in the court)?!
We claimed that since my mother is my dependent family member and she is a registered carer for my disabled grand-parent, this qualifies him as a dependent family member too. I am now seeing concerned with this causal dependency. Can you please share your view on this one? He resides in my property, his pension is insufficient to pay all his medical bills and I pay them. Additionally, he cannot walk, is Spam dependent (24h/day) and requires assistance with medication / care. He also develops initial signs of dementia.
