Guidance on ILR, Dependant Visa Extension, and Newborn Child Citizenship Application

Dear fellows,

I am seeking your advice regarding my ILR application under the Global Talent Visa (GTV) route, as well as the visa and ILR timelines for my wife and our newborn child. Below are the details of our situation and specific queries:

1. My ILR Timeline
I received my Global Talent Visa on 20th February 2022 and arrived in the UK on 3rd March 2022.
Based on the 3-year residency requirement, I understand I can apply for ILR 28 days before 3rd March 2025, i.e., from 4th February 2025.
Please confirm if my understanding of the timeline and eligibility criteria is correct.

2. My Wife’s Visa and ILR Timeline
My wife arrived in the UK as my GTV dependant on 14th May 2022.
Her current dependent visa will expire on 14th April 2025, and I understand she needs to extend her visa to complete the 5-year residency requirement for ILR.
Based on her arrival date, I calculate her eligibility for ILR to be 28 days before 12th May 2027, i.e., from 14th April 2027.

Please confirm:
a. Should I apply for her visa extension before applying for my ILR or before her visa expires in April 2025?
b. If I get ILR and then apply for her extension later, will she apply as an ILR dependant or a GTV dependant?

3. My Child’s Citizenship
Our baby was born in the UK on 2nd December 2024.
I understand that a child born in the UK is eligible for British citizenship by registration once one parent obtains ILR.
I plan to apply for my child’s citizenship immediately after receiving my ILR in February 2025.
Do I need to apply for any visa for the baby in the interim if we do not plan to travel abroad before obtaining my ILR?

Confirm my ILR eligibility timeline and application date.
Advise on the visa extension process for my wife.
Clarify the steps for registering my child as a British citizen and whether a visa is needed before my ILR is granted.

2.
a. She should apply just before visa expiry.
b. You getting ILR changes nothing. She will remain/continue under the same route, so extend as GTV dependant.

3. Visa not needed. Apply for registration using form MN1 when you got ILR

Dear Zimba,

I have received my ILR confirmation and am now applying for my newborn baby's UK citizenship. However, I have encountered the following issues:

I had not applied for a Pakistani passport or national ID card, but the MN1 form now requires nationality details, which my baby does not have at the moment. The form then asks if you have a biometric residence permit (BRP); however, my baby does not have one. My baby also does not have any travelling documents. Furthermore, the form asks: "Explain why you are unable to provide a valid form of identification." I provided the following explanation:

I am writing to inform you that I was born prematurely on 2 December 2024 and had to spend over 60 days in intensive care at New Cross Hospital and Walsall Hospital. As a result, I was unable to apply for a Pakistani passport or any travel documents at the time. However, I have a birth certificate that confirms I was born in Wolverhampton, United Kingdom. Please let me know if you require any further details. I appreciate your understanding.

Additionally, there is an option to enter the address where the baby lives, after which I must indicate whether the baby has lived there for the past five years. However, as the baby was born only two months ago, when I selected "less than 5 years", the MN1 form then requested that I enter all previous addresses, which does not make sense.

Could you please advise me on what I should do in this situation?

Don't worry about the passport. The child's birth certificate is sufficient. This is quite common so I wouldn't bother with a detailed explanation.
Caseworkers will know the age of the baby - just fill the same address for each year - common issue, no problem.
This is just my opinion as a member of this forum and does not constitute immigration advice.
