Do I have to stay in full time education to get ILR?

Post by alusto » Thu Oct 13, 2016 3:00 pm

I am currently 17 years old on a settlement visa accompanying my mother in the UK. We got the settlement visa because my father is a British citizen. We have currently lived here for 1 and a half years and require five years to get ILR. My question is, after I finish my last year of secondary school, is it compulsary for me to stay in full time education such as University to remain a dependant under my parents, or is this not necessary?

Thank you.

How is your father British? Did he naturalise as British or is he British by Descent or British born?

How long has he lived in the UK before you came to live here?

Has he lived in the UK in the past, at any time?

When do you turn 18?

He lived in the UK for 6 months before we all moved here.

I turn 18 next year July, so i will have lived here for 2 years 6 months, and i will have 2 years 6 months to go till i am eligible for ILR.

I think CR001 is trying to establish whether you are eligible for a section 3(2) or 3(5) registration as a British citizen. The former requires the British parent to have lived in the UK for at least 3 years before the birth, and the latter requires the parent and child to have lived in the UK for at least 3 years after the birth. Unfortunately the entitlement only lasts until the age of 18, so it looks like you're just going to miss that opportunity, which is a shame as it would have made things a whole lot easier for you.
