Help needed with the right type of application

Help needed with the right type of application

Hello,

Could anyone please confirm the following. The reason I would want a confirmation is that I have in the past contacted UKBA and different people have given me different answers.

1. Can the application for ILR under the 10 years period using the form SET(o) be applied through the post only or I can avail the premium service?

2. My wife has been on an HSMP dependant visa for the last one year, would her visa become void if my status changes from Hsmp Tier 1 to ILR? If that is so, when is the best time she can apply, should she apply with me using FLR(m), or should she apply separately after I have obtained the settlement visa.

3. My daughter was born in UK six months ago and she doesn’t have any passport or visa. We both are Pakistanis. According to UKBA we can apply for our daughter’s visa as a dependant of mother or as dependant of father. If I apply for her visa as my dependant at the time of my application, should I include her details in the same form SET(o) or should I apply for her ILR separately.

I was given an advise on immigration board that she is perhaps entitled to british citizenship through 1(3) as per form MN1. However, UKBA told me that even after receiving my settlement visa, my daughter would not be entitled to citizenship as she would not have had ILR. UKBA advised me either apply for daughter as dependant on wife’s marriage visa, or apply separately in SET(f) after I obtain ILR.

I would be extremely grateful if my queries could be resolved.

1. Postal application only.
2. Preferably switch to FLR(M) after you're granted ILR. However, definitely apply before her leave expires.
3. Incorrect advice given by UKBA.
