ICT Tier 2 to ILR

Post by darkmatter7810 » Mon Mar 02, 2020 1:47 pm

Hi,

My family and I are presently on ICT five-year Tier 2 visa, which is going to expire in October 2020. I have the option to get my visa extended for another four years based on the compensation guidelines. I was wondering, does my time spend in the UK on ICT Tier 2 visa count towards 10 year long residence route towards ILR? My question obviously assumes that post spending nine years in the country, my dependent wife would be able to find an ICT General sponsor, which will technically help us cross the 10 year mark?

All visas count for long residence ILR, even visitor visas.

Thanks so much for your prompt response, CR001

So just to summarize, if my family and I (individually) haven't spent more than 180 days in a year or 540 days in total outside of the UK and have completed ten years of continuous living in the UK (first 9 years on ICT Tier 2 (husband) + dependents (wife and child) and the last one year on ICT General (wife) + dependents (husband and child), are we eligible to apply for ILR under the 10-year long residence guidelines?

I appreciate that I am perhaps asking the same question slightly differently, but just wanted to be absolutely sure!!

Correction, I meant Tier 2 General for my wife and not ICT General.

Just to add, in this case, will the 10 year rule apply or would we have to wait for 5 years after my wife gets Tier 2 General visa to apply for ILR under that category

There is no '180 days per year' rule for long residence ILR. It is ANY single absence of 180 days or more that breaks continuity of residence for ILR LR.
