ICT Visa , right to stay query

Post by shahujwal » Tue Jul 11, 2023 10:25 pm

Hello ,
I am on ICT visa & my employer has asked me to move back to my home country by Aug 18.
My current BRP is valid till Dec 24.
My wife (on dependent visa) is working as well here & was planning to go maternity leave from 7th Sept . In worst case scenario if I leave UK , can she still stay in UK & work for 15 more days to be eligible for her SMP

Yes , we planning to leave the country.
But she hasn’t informed her employer anything about leaving the country. Just have informed them about maternity leave dates

SMP is paid through the employer. If you are both leaving, she can't claim the benefit.

But I heard after visa cancellation by employer , we can still stay in country for 60 days & my dependent can work for 60 days.
Isn’t that correct understanding ?

If you leave your dependents also have to leave.

I think that you and your dependents can stay in the UK until your (and their) visas are curtailed by the Home Office, which can take weeks.

So, I suspect that your wife can stay an extra week or two.
