ILR 10 year route

ILR 10 year route

Hi, I have been in the UK for the past 9years and 3 months. From January 2025 I will be switching to a student visa which is only valid for 10months (expiring in October 2025). However, I will have, completed my 10 years of continuous residency in september 2025. But because I swithced to my student visa on January 2025 and have not been on that student route for the past 12months according to the new law in April 2024 I would not be eligible or is there room for discretion ? what should I do despite being in the UK and having completed 10 years but because of the rule change.

There is no discretion. Also, there is no automatic entitlement to grant ILR to someone just because they have lived here for 10 years. You need to have been on your current visa route for at least 12 months as per the rules of the long residence

so what would my alternative be after completion of my course and having completed 10years of lawful residence how would one qualify for ILR on the 10years route ? Switching to another visa for 12 months?

You can only get ILR if you qualify for it. The '10 year' route to ILR has some more requirements than just having spent 10 years of lawful residence in the UK. So merely fulfilling the lawful residence requirement in the UK is not going to be enough
