ILR - 180 day rule for Tier2 dependent (under 18)

Post by sathish8427 » Sun May 31, 2020 9:52 pm

Hello,

I hope everyone is fine during this critical time.

I'm applying ILR for my daughter who is 10 years old. In the application form, it did not ask any information about the days of absence outside UK.

Does the Tier 2 dependent (under 18) do not need to satisfy the 180 days rule?.

Thanks in advance.

Which form are you completing?? Set O?

PBS dependents only have an absence limit if their visas were granted on or after 11th January 2018. If her visa was granted before this date, then there is no absence limit.

Do both her parents hold ilr?? Through tier 2 with 5 years residence or ilr based on 10nuears long residnece??

Thanks for your reply and sorry for not being clear.

Yes, I am applying for ILR from Tier 2 dependent (tier 2 with 5 years residence).
My daughter's got her tier 2 dependent visa extension in June 2017 and expires in June 2020.

Do both her parents hold ilr??
yes, we both have granted ILR recently.

Thanks

Children do NOT have such requirement. Also, they do not need to complete a 5 years qualifying period. Why didn't you apply together ?!

Thanks for your reply, much appreciated.

Why didn't you apply together ?! - because I did not had the budget to apply for everyone.

I hope it would not be a problem applying alone for my daughter.

Thanks
