ILR IELTS Validity

Hi all,

Back when I applied to get a Tier 2 Sponsored Work Visa, the Home Office required an English Test. I took the IELTS test (Academic) and scored an overall CEFR Level C2.

Everything with my entry documents went smoothly so fast forward to now, after 4.5 years, I am readying my application for ILR.

I know the English Test has a validity of 2 years and was under the assumption that I needed to take another IELTS test again for ILR application. But I stumbled upon this page — https://www.gov.uk/english-language/app ... ifications and now don't know if my IELTS test from 2017 is still valid and that I actually DON'T have to retake it anymore?

The home office page says:
"If your qualification has run out : Some recognised test qualifications only last for 2 years. You can still use a B1 level qualification that you took more than 2 years ago in 2 situations.

Applying to settle in the UK: You can use a B1 level qualification that’s run out if both of the following are true:
  • it’s on the current list of recognised tests
    It was accepted for another UK immigration application, for example when you got permission to enter"


As far as I understand my test would fit under this circumstance?
It's on the current list of recognised test >>>> IELTS?
It was accepted for another UK immigration application >>>> It was accepted when I applied for Tier 2 and was given a work visa to enter the UK? My result level is C2 which is higher than B1 (hierarchy goes B1 > B2 > C1 > C2).

I'm grateful for any advice 🙏

Hi all,

I understand as per the rules, you can only apply 28 days of/before being in the UK for 5 years.

BRP Date of Issue: Aug 29, 2017
Visa Entry Given: Aug 28 — Sept 29, 2017
Entry Date: Sept 21, 2017

Just wanted to confirm if I should apply on:
— 5-year visa start date anniversary — Aug 28, 2022 (minus 28 days) or
— 5-year entry date anniversary — Sept 21, 2022 (minus 28 days)?

Also is it minus 28 days (weekdays/weekends) or minus 28 working days? (Sorry if this is a dumb question).
Appreciate any response/answer 🙏

IELTS UKVI is the blanket name that covers IELTS Academic and IELTS General Training. So you are fine. But check the provider and centre from the list. Each centre has a unique code. This code is available in the spreadsheet. Compare it with your certificate. If the code on your certificate is in the spreadsheet no ned to worry about.

Indeed, Since 1 December 2020, migrants who would previously have applied for settlement in the UK (aka “indefinite leave to remain”) under the Tier 2 (General) route now need to apply under the new Skilled Worker route. So there is no Tier 2 anymore.

There used to be an English language requirement for settlement applications made under Tier 2 route. This has been removed in the Skilled Worker route.

Another quick question:

I've read people saying you can apply for ILR anytime and you just save it and submit later.
Is this true, or is the earliest you can actually access the forms/ILR portal is 28 days prior your 5 years.

Long story short, can I do ILR application online now even if my earliest to apply is in AUG 2022?

You can access the form at anytime. An application remains live for 10 weeks before it is deleted.
