ILR - Dependant

Post by rajainbox » Fri Sep 09, 2011 2:10 pm

Hi All,

I am applying ILR using SET (O) along with 2 dependants (wife +1 child). I am confused that Should I fill 2 SET-M application forms for Dependants when they apply along with me?

Your answers must help us. Many thanks.

On what basis are you applying for settlement? .... economic migrant / long residence / etc. ... ?

Answer

Can I include my dependants in my application?
You can use one form for a joint application by you, your partner and any children aged under 18, if they are applying as your dependants. Children over 18 must apply separately.

Gidoc, your reply may be confusing as it is not as clear cut as the words of the text you are citing seem to indicate. The eligibility of the spouse to apply jointly with the PBS migrant comes with strings attached and hinges on the answer to Greenie's question.

I agree however OP wanted to know if he needs to apply separately for dependants or use one form SET O. One assumes that the spouse is eligible to apply together, hence his question and my answer.

it should not be assumed that the spouse is eligible to apply with the main applicant until the OP has answered my question.

Your spouse is not your dependent child over 18. You may include your spouse and child under 18 in your SET(O) application.
