ILR Dependent(Tier-2 ICT Dependent) extension Documents

Hi All,

I have been regular member of this forum, I have been granted ILR in jan-2015 and my spouse joined me in UK after July-2012 so she was not eligible for ILR, Now her current visa is near expiry and we are looking to extent her visa as Tier-2 ICT dependent so that her 5 year cycle does not reset. Can anyone please let me know is it correct way and also what documents do I need to submit for her.

Yes, she can continue to extend on the PBS Dependent form if you got your ILR based on Tier 2 ICT.

No, the health surcharge is not applicable or payable for Tier 2 ICT dependents. You might still need the IHS reference number though but nothing is payable.

I have received below email from home office, Can anyone please guide me as soon as you can?

Dear Mrs ABC,

Further to your Tier 2 application on 27 October 2015, we cannot complete the application until the IHS payment has been received.

As you are applying as a dependant of a person who has been granted Indefinite Leave to Remain, you are liable for the IHS payment for 36 months. The amount due is £600 for a visa up to 3 years. I have amended the system and you should have received an email regarding this on the 9th of December 2015.

The IHS reference to pay your outstanding amount is: IHSXXXXXXXXXX

Once you have paid the outstanding amount, we can complete the application.

If we do not receive the payment by Tuesday 22 December, your application will be rejected.

I wonder if the exemption is only relevant if the main and dependents apply for Tier 2 ICT together. This is the first I have seen this since the surcharge has been introduced. And did you definitely select the category /sub category of Tier 2 ICT dependent?

Suggest wait for Vinny or Sushdmehta to comment.

Yes I am definitely sure, I have selected form for Tier-2 PBS Dependent as in above link. Do you have any guidance on UKVI site that I can follow and reply to email from home office?

Did you clearly select Tier 2 ICT dependent?

You need the IHS reference number but from what I can see on the .gov website, Tier 2 ICT and dependents are exempt.

Thanks for reply but doesn't Tier-1 comes under PBS and all PBS dependent has same rules?

No they don't. It is only Tier 2 ICT main applicant and dependents who are exempt from the immigration health surcharge. ALL other visa categories have to pay it, even Tier 4 student visas.

Yesterday I paid IHS and then sent email to caseworker and he has responded with below reply.

Good Morning XXXX,

Please accept my apologies for my oversight.

I have looked again at your application and see that your partner has got ILR in the ICT category so applying as an ICT Dependant is the correct application, as you have submitted.

I will look at your application today and try and get things sorted out as soon as possible.

I can conform that your application will be considered as a ICT Dependant, where IHS is exempt.

Once again I do apologise for the oversight and hope this has not inconvenienced you too much.

I will of course be refunding the IHS payment of £600 as soon as I complete your application.
