ILR eligibility for Tier 2 dependent

Post by kramya » Tue Apr 03, 2018 2:12 am

Hi all,
I came to uk on oct 2014 on Tier 2 general dependent visa which was initially granted till 14/4/2017. I could extend my Tier 2 general dependent visa successfully till jan 2020.
My husband came to uk on sep 2009 on student visa and got his tier 2 general visa on jan 2014 initially and could extend his tier 2 general visa till jan 2020

I wii be finishing 5 years on 20/10/2019 on Tier 2 general dependent visa and would like to apply for ILR on oct 2019 along with my husband who is applying for ILR based on 10 years route..We are going to apply for ILR visa at the same time through premier service.

Now I would like to know that does my ILR application outcome depends on my husband's ILR application outcome ie

If my husband's ILR application is successful then my ILR application will be successful

If my husband's ILR application is not successful then will ukvi will reject my ILR application??

Please clarify on this query..Thanks in advance.

You cannot apply for ILR as a PBS Dependent based on 5 years residence if your husband applies for ILR based on 10 years long residence. The rules no longer permit this. You will have to switch to FLR(M), which will be a new 5 year (2 x 2.5 year visas) residence period before applying for ILR based on 5 years residence (or 10 years long residence if you reach that first).
Now I would like to know that does my ILR application outcome depends on my husband's ILR application outcome ie
See comment above. Your FLR(M) application success will depend on your husband getting ILR.
If my husband's ILR application is successful then my ILR application will be successful
FLR(M) yes, IF you meet all the requirements.
If my husband's ILR application is not successful then will ukvi will reject my ILR application??
If your husbands ILR LR fails, your FLR(M) will also fail. You will lose your fees.

Hi CR001,
Thanks a lot for your quick reply..My Husband is earning 27 k now and he would like to apply for new companies where he will be able to earn more than 35k salary..if he is able to get new 35k salary job after passing RLMT with new company then he will apply for new Tier 2 general visa after serving notice period with the old company..
In that case can I continue with my existing tier 2 dependent visa which is valid till 24/1/2020 or do I also need to apply for new Tier 2 general dependent visa along with my husband while switching from old company to new company..
Please clarify on this..thanks in advance..
