[QUESTION] ILR + employment on cruise ships

Hi!

My American husband received confirmation of first FLR(m) visa, which has been approved! We're incredibly happy, but it's naturally got us thinking about the ILR five years down the line.

I've tried to find an answer in the forum for this, so please do forgive me if I've missed!

My husband is a cruise ship entertainer, and is often on contracts for long periods of time. I've read about the 180 day outside of the UK rule, but I was wondering if this definitely counts towards cruise ship workers, too? My reasoning being that his wages would be paid into a UK bank account and he'd be paying UK tax as well as NI, as cruise ship workers get paid and taxed according to their country of residency's laws.

So if he's paying UK tax, and we live together at a permanent address of which he's on the lease, and he contributes to bills, council tax etc., does this 180 day rule still count?

This applies ONLY to Tier 1 and 2 visa holders and their dependents and NOT to FLR(M) spouse visa, which has no absence limit.
