ILR for my family who will qualify later after me

Post by seragammar » Mon Nov 27, 2017 10:13 pm

Dear all

I got my first Tier 2 general VISA for me and my family on 13/12/2012. I entered UK on 01/04/2013 and the family entered UK 17/08/2013.I have the following queries

1- Can I apply for myself on 01/04/2018 and then apply for the family on 17/08/2018. If yes, do I have to change the their current valid VISA (valid till 12/12/2018)?

2-Can I apply to myself and my dependents ( 4 boys including the ones of 16 and 18 years old) and then I apply to my wife on 8/2018 , again do I need to change my wife's PBS visa even it is still valid

3- My eldest son is over 18 years old, he is fully dependant on me. What are the supporting documents to be included in his application. I understand that he has to submit a separate application for himself.

Thanks in advance

1. Yes you can apply for yourself and later for family provided they still have a valid visa at that time. No they do not have to switch visas if you apply for ILR based on 5 years residence Tier 2.

2. No. Children will qualify when your spouse does.

3. His own Set(O) form as he cannot be included on your spouses form and it will tell you what is required.

Hi CR001,

Thanks for your prompt response.

Re-No.1, just to confirm that my wife and my children current tier 2 dependent valid VISAs will be kept as is with no change at all if I am granted the ILR on April 2018.

Thanks in advance.

Correct. No need to change their visas. Their current visas will remain valid.
