ILR query for change of Status

Post by ILR_MN1 » Mon May 20, 2019 3:50 pm

Hi All,

Last My friend applied for ILR through 5 year spouse route which was refused on the ground that her husband didnt show the income for full year. He was employed for 6 months in that year and then opened a company for the next six months. HO didnt consider his salary from his company as they said, its the company income they will look at rather than his salary from his company.

HO provided my friend FLR family visa for 2.5 years instead of ILR.

My question is whether she can now apply for ILR as her husband has all the income required according to HO or is she now one different route and have to wait for another 5 years before applying for ILR.

If you need any further information, please do let me know. I look forward to hear from you.

Kind Regards,

I think because he hasn't completed the full year on his self employment and that's why he was failed to meet financial requirement. HO now put him on 10 years FLRFP route and his previous time spent on FLRM won't be counted. However, all of his legally time spent on all visas will be counted towards ILR under 10 years of long residence route (SET LR).
