ILR Renew - Expiring on 10th October 2023

Hi All,

One of my clients issued the ILR on 10th October 2013 which expires on 10th October 2023, after 5 years (around 2018) she applied for British Citizenship but it was rejected as being TOEIC English Language, Her husband is a British Citizen and the rest of the children are British Citizens too, currently, she is doing great work and work with the Local Authority in very senior post good reference and character, only her ILR is expiring on 10th Oct 2023, may I know what is the best renew the ILR if yes or now if yes renew how to renew the ILR.

Which forms does he have to fill out to renew the ILR?
How many it cost?
If she renews the ILR, does she have to retake the English Test or Life in the UK test as before or not?
If yes how soon can she apply the ILR before the ILR expired?
Is there a chance to apply for re-apply the British Citizenship before her ILR expired on 10th October 2023?
If she entitles to apply for British Citizenship how much does it cost and will there be a strong case to apply or not? If yes how to convince the Home Office that she is doing great for society and will be a real asset to the British?
If yes how soon can she apply for the British CItizen before the ILR expired?
If she renews the ILR, does she have to retake the English Test or Life in the UK test as before or not?
But the question is that when we see her settlement status from the Home Office page, it said she can stay and work without any limitation but why there is an expiring date on the BRP card, so confusing?

Please advise.

It is the BRP CARD that expires, not the ILR status! She renews the card, like a drivers licence would need to be renewed.

Note that all BRP cards will only be valid till 31st December 2024 when they will no longer be issued and the system will become a digital one.

As Char pointed out, ILR is not a card but a status that is permanent and does NOT expire or does not need to be renewed. The BRP expiry card has no bearing on the ILR status. BRP currently is simply used to SHOW/PROVE your status when required. A BRP holder simply applies to replace the card and gets a new card. That is all.

BRPs are only issued with validity till the end of 2024. A new digital proof of status system will be introduced very likely from early 2024. After the end of 2024, that system will exclusively be used to SHOW/PROVE your status instead of a BRP.

The process of British citizenship is a totally separate process and has its own requirements including proof of English language requirements, absences, etc as well as good character requirements. I suspect she failed the good character requirement ?

Note that citizenship is only granted at the discretion of the secretary of the state, so the home office is not obliged to grant citizenship to anyone unless they see fit.

If my client has to replace the ILR BRP card which expired on 10th October 2023, then please advice How to proceed? How much does it cost? Does she need to fill out any sort of form? Does she need some documents to replace the new ILR BRP card?
Also regarding the British passport: If she applies now will there be any chance will she be granted?

BRP replacement costs £56 at the moment. You have already given the links to follow!
You cannot get a British passport unless you first become a British citizen. Her naturalisation application must be approved first as a British citizen, then she attends her citizenship ceremony and gets a naturalisation certificate. It is only then that she can apply for a British passport
