ILR settlement visa for my wife and kid

Post by Harichanda » Sun Nov 15, 2015 6:27 pm

Hi,

I am on ILR settlement visa ( got in 2013) and my wife is planning to apply for settlement visa for her and our kid. She arrived to uk in April 2012 on Tier 1 dependant visa and she is currently on PBS dependant visa which expires in April 2016 . Baby is born in India last year and arrived to UK in May 2015 and she is currently on PBS dependant visa. Please note that she was in india from June 2014 to May 2015 for our baby delivery.
Could you please let me know what form do they need to apply through ( I think SET (O) form) and is she eligible to apply now as she was out of UK for the last 180 days ? Also could you please let me know what are all the supporting documents she needs to provide?

Thanks in advance.

Set(O) is for ILR.

What exactly is she applying for, ILR or PBS extension?
Char (CR001 not Casa)

Why do you believe your wife qualifies for ILR when she has only completed only 2 years of residence? i.e Arrived in June 2012 and was absent for almost 12 months. 5 years of residence is required for ILR.
(Casa, not CR001)
