ILR or visa extension after initial 2 yrs partner visa

A bit confused here and thought I get confirmation from here before relaying the message. Wife is British Citizen and husband visa as D Partner (standard) valid for 33 months expiring on March 21. Biometric has Leave to Enter. Not sure whether it's 5 year or 2 year route and no idea where to find this info.

We checked online if you can apply to settle in UK suggesting " You may be entitled for settlement (indefinite leave to remain)" with below questions:
1) You're family member or partner of British Citizen
2) Your partner settle before BC - NO
3) Relationship - Partner
4) Current situation - still with partner

On clicking Apply online, then there is a guidance saying that you should only use this only if you've completed 5 years.

I googled and few results came up for needing to extend for another 30 months. I think we directly applied for settlement for my wife but that was long time back.

You need to complete 60 months in the UK before you can qualify for ILR for SET M under partner route from the time you arrived in the UK.


"E-ILRP.1.3. (1) Subject to sub-paragraph (2), the applicant must, at the date of application, have completed a continuous period of either:

(a) at least 60 months in the UK with:
(i) leave to enter granted on the basis of entry clearance as a partner granted under paragraph D-ECP.1.1.; or
(ii) limited leave to remain as a partner granted under paragraph D-LTRP.1.1.; or
(iii) a combination of (i) and (ii);"

There is no longer the availability to apply for the 2 year route and has been the case since 9th July 2012. There is only a 5 year route to ILR now.

Since it is Standard that makes it the 5 year route and if the initial 33months is what is coming to an end in March then an extension is in the offing.
