ILR on 10 years timeline confusion !!

Dear All,
I am going to complete 10 years in this country on 25th Aug 2019 with below mentioned timeline. Can I apply for IRL on 10 years basis in August 2019?
My tier 1 entrepreneur application was rejected and applied fresh one which was approved after 1 years time. Does this all waiting and refusal etc.. will be counted towards 10 years ?
Can i apply ILR for my spouse as well? She has completed 4 years onl.

Timeline:
Arrived UK Tier 4 Student: 25 Aug 2009 to 2011
Tier 1 PSW: 2011 to 2013
Tier 1 Entrepreneur: April 2013 to April 2016
Tier 1 Extension Applications sent: 14 April 2016
Refuse letter dated: 28th Sep 2016 (Due to FPS issue)
Admin review on: 11th Oct 2016
Admin review refused: 11th Nov 2016 (Letter received 17th Nov 2016)
Fresh application submitted on: 24th Nov 2016
Approval Fresh Application: 30 Nov 2017 to Nov 2019

Dear Zimba,

Thanks for your reply. So, i understood that the waiting time between 1st application, refusal, new application and approved this period of time will be counted in 10 years.

What shall i do for my wife visa ? Shall i apply with my ilr application in August 19 or Shall i apply her application separately in Nov19 as dependant when the current visa expiring?

Long residence is an application where you must apply on your own and you must qualify on your own. Your wife should apply for FLR(M) separately if she does not have 10 years

Each application is individual and separate. Her FLR(M) will be held until your ILR LR is approved. If your ILR LR fails, her FLR(M) will also fail.

Yes, English requirement and £18,600pa proof of income. No 'minimum balance' requirements though.

I think, i will apply alone for ILR(LR) in Aug19 and once my application approved, will apply for my wife FLR(M) in Nov 2019. I am not withdrawing any salary at the moment, Will that be alright if i put my self on payroll from (May19 to continue...) for my wife visa ?

She is working full time? Her own payslips will be considered as income proof for her application ?

For her FLR(M) I will submit my payslips (May 2019 to Oct 2019, shown as £19000 per annum) and will submit her payslip as well (for last 12 month, shown as £18000 per annum(nov 18 to March 19), £21000 per annum for (from April 2019 to Oct19). Hope should be alright. Many thanks

Dear members,

I am planning to apply my Set(LR) next week, please refer the below timeline/dates and notes. Please guide me if I am missing anything.

Timeline:
Arrived UK Tier 4 Student: 25 Aug 2009 to 2011
Tier 1 PSW: 2011 to 2013
Tier 1 Entrepreneur: April 2013 to April 2016
Tier 1 Extension Applications sent: 14 April 2016
Refuse letter dated: 28th Sep 2016 (Due to FPS issue)
Admin review on: 11th Oct 2016
Admin review refused: 11th Nov 2016 (Letter received 17th Nov 2016)
Fresh application submitted on: 24th Nov 2016
Approval Fresh Application: Nov 2017 to Nov 2019
Set(LR) planning to Submit: Sometime in Aug 2019

I am worried about the time I had spent during the T1 Ent extension waiting(refusal, admin, fresh app. etc..), Does that will be counting as overstay? Do I need to be declared in the application? or Shall I write a separate cover letter with a detailed explanation?

Shall I include any docs in regards to my businesses e.g. Bank statements, employees details etc.

Do I need to submit any docs for my dependant wife (in relationship question), her application FLR(m) will submit separately once my ILR approved.

Docs ready to submit:
- Copy of Student visa & Old passport
- PSW BRP card copy
- T1 Ent 1st BRP Card copy
- T1 Ent 2nd exn. BRP card (Current)
- Passport
- Life in the uk test pass certificate
- Master Degree from UK university
- Wife Passport copy and BRP copy, marriage certificate

Your advise and comments highly appreciated...

Hi Zimba,
Many thanks for your response.
In 2011, My PSW BRP and 1st passport were reported as lost which had my student visa stamp (after obtained new passport and New PSW BRP).
Will this create any issue to prove 10 years of legal stay?
I have the copy of that passport(1st and last page, visa stamp page) and also have police reference report for the same.

Hello there,
some urgent queries, as i am completing SET LR online,

Question on the online form :
Do you have any other reasons for wanting to stay in the UK? (shall I write about my businesses and social life etc.. or just simply choose NO

I regard to absent from the UK (I have mentioned that my parents live there and visit them regularly to spend some family time with them.) Will that be alright?
Do i have to pull my all siblings name and friends names ? as the online form giving the box to put words....

Please, urgent reply..highly appreciated...

Hi Zimba,
Thanks for the prompt reply...

The saved form says on 1st page "You must include all your reasons for wanting to stay in the UK on this application"

Just saved the online form to complete later and noticed fees £2408.20, I believe it supposed to be £2389 ?
£2408.20 includes biomentic fees £19.20 ?

Please clarify asap if possible,

Just answer No. The biometrics fee are added too that is why it is a bit higher

Excellent.. thanks for the quick answers..

One more questions...the form asked about the employment details.
I have given details of my own company name, address. etc... and mentioned that working as a company director(own company) with starting date from the company formation back in 2013. At the time i was in psw visa and was working somewhere else and left the job as soon as my visa approved.... do I need to clarify this to caseworker? Shall I put the visa approval date as the starting date?

Annual earning declared as per the current salary but sometimes i am on and off on the payroll.. will that create any confusion?

Hi Zimba,
Could you please answer the previous query if you can please.
I am on T1 ent..taking a salary from my ltd company as director remuneration...Will that be considered as self-employed or employed. I am also running 02 other companies at the same time but not taking anything from there. How shall I mention on the form?
I asked my accountant and he said my employment status is considered as self-employed. but I am Really confused and stressed, I am maybe overthinking... pardon me for such questions...

If you are on the company payroll you are an employee of your own company. The starting date is the date you were put on payroll and the leaving dates should match the P60

Thanks for the reply. I have already submitted the application. But i had selected as self employed and mention the annual income as per the current payroll. I have also disclosed my other company details as well. As i did not wanted tht I don’t disclose now and they come up with why I haven’t provided such information.
I have also submitted small cover letter as well with explaining situations e.g. working for my own company and the current income etc...
I had to pay extra £100 for an appointment for next week and £85 extra for other scanning and checks service.
Hoping will get the positive outcome.

Hi there,
I have an appointment at UKVCAS on 07/08/2019, applying main applicant only.
The document list ask document for wife passport and visa status and address etc...Does she need to sign a consent form and to be present at the appointment? Will they take mine and her original documents passport BRP etc.. ?
