If you are in a relationship with the mother, then the prospect of success under parent route is very limited.

I Need a Quick adivce please i came in UK with my Elder Son in March 2011 that time boy was 8 year old and applied Asylum which were not sucessful but fresh claim was still under process while i had relationship with British National and ive a baby boy whos 5 month old now im just confused which route is More effective for me 7 years bases or father of a British born baby and because we not living toghter i mean me and my partner ive got a court order to see my child on daily base ? please if you advice ill be thankful

Well when you go into this thread, it is clear that I have given you more than 1 advise, advise you in the summer about the unborn child, the GCSE child who is not here 7 years yet, and the prospect of success once the unborn child is born.

The only thing I have not done is probably file in the fresh claim form, package it and personally drop it for you in Liverpool.

I have not treated you any differently from any member on this forum.

Therefore trying to portray me in a negative light will not fly. I have assisted you. You just need to read what I have said since the summer.

I did not delete your post, but have merged it with this topic.

To answer your question, is this a matter of "either or" or just plain "or"? If it's the latter, then why not choose to include both grounds?

Thank you So much Vinny just a Quick update as well. My pending Decision has arrived which is Refused as they said i failed to produce Valid documents that this child is mine and very Amazing one of a Reason i used (home office) instead Home Office in typing means used lower letters lol well
ive sent them brith certificate
British Passport of Child
pictures of Child with me
But this time they given right of appeal which im going to apply My Barrister advised me to produce Court arrangment order which i have now then any letter from gp thats more then enough
im not sure about first tier Tribunal how they going to treating my case but lets hope for good

Had Court Hearing Yesterday (First Tier Tribunal) started 10am finished 11am . Total 1 hour
No evidence Challegend By Home Office Representative no Extra Questions asked by Judge and HO Representative. End of Preceding HO Accepted genuine Relationship with partnar and Parental Responsiblities with Child all evidence accpeted but just one issue raised by HO representative that my immigration Histroy is very poor . and my Solicitor challegend this
Honourable Judge was seen quite convinced and he asked me what you going to do (Work) if i allow you ?
i explained this

my Solicitor was confident after hearing but still Not 100% Sure

Child arrangement Order it self has weight Doesn't matter how many hours (as per my own Case experience) all you need to show that you has a parental Responsibilites. As well as if you visited to Childs GP School etc if you can provide Pics with Child .

No my case is not in immigration court .
My case is bit complicated and confusing me.
I was her on spouse visa and due to separation border force cancelled it with removal direction.
I had to make fresh application 10 years parent route .
I sent the application by post on 6/1/2018 And paid the health surcharge.
But 1st February they refunded the money and ihs withwithout explaining what happened .
So it's been 16 days now I don't know if they are treating my application as invalid or they are treating it under section 120 which is free ( that is what my solicitor think)
And if it was invalid they would of sent the application with supporting documents by now but they havn't send any yet).

Any way I went to the court to ask for child arrangement order because my ex not letting me see my son.
Hearing was listed 8th januarey and I had court order stating that I can spend time with my son supervised in contact centre every 2 weeks.
But it's not final order yet as we have Next hearing next week fact finding hearing to see if my ex allegation was true or not.

How can I prove my parental responsabilites?
My name is on my son birth certificate that means you have automatic parental responsability
I also phoned his GP and he gave me a letter stating that I attended twice with him to doctor and he put the dates although I attended more than that but doctor said he couldn't find me there just 2 times is that useful?
I started to sent money to his mum straight away after separation aswell.
And I sent nearly 150 photos together me and my son
Playing with him feeding him sleeping together but all of that was before separation.
We just got separated 4 month ago anyway so it's not long time ago.

My solicitor wrote to the home office to ask what happened and to sent the court order as I didn't have it on the time of the application but havn't heard anything yet from them and I don't know what to do next .
Just wait or what .
Ian on temporary admission and my reporting date will be on 6th of March which is soon .

What else I can do to prove parental responsabilites ?

Secondly as far as i know only birth certificate isnt enough even though Rules said if your name is on brithcertificate you have an automatic responsibility but HO Does not accept this thats why they Refused my case and given me right of appeal because they said birth certificate isnt not showing parent Responsiblity so i produced Dr's letter which you have as well is very valid document to show your responsibility and pics too try to explain with a caption on every pic Date month age of child it will be helpful
and to be honest i dont know about the fee they refund but just an idea if they taken your biomatrics then nothing to worry even if they sent back money but if this is before biomatrics then its a issue
a Very good luck to you too your child arrangment order is a valid document Because it proof you are father of child and still in contact with your child im quite sure you going to get your Visa

Thanks a lot my Submission took almost 6 months to get a decision and appeal hearing was very quick with in a month. applied for appeal mid of January and hearing date was mid Feb
