When can I apply for spouse visa extension?

Hi,

Im really confused with all the info I read here, I just could not figure it out.

I arrived here in the UK on 9 Dec 2019 on a spouse visa. My BRP expiry is on 9 September 2022.

When can I apply for extension? I dont understand that 28 day-rule idea?

It keeps being repeated that it is not a rule but a concession.
You are eligible to apply from 12th May 2022 till 9th Sept 2022 which is the expiration date of your current leave.

thanks I am in the same boat, i just wanted to clairyf how this was calcluated? please can you provide a reference

if my maths isnt wrong that is 885 days from arrival?

I think if you have sufficient leave, then it’s better to extend after spending at least 30 months in the UK, so that you don’t have to rely on a caseworker’s discretion to add extra days to cover your 5 years qualifying period. If possible, then It’s probably optimal to extend no sooner than 28 days prior to expiry of leave, but definitely before expiry of leave.

Spouse Visa Extension: My husband's children with ex-wife

Hi All,

Thanks in advanced for all those reading this and for your comments.

So Im now filling up the online form to extend my spouse visa.

I arrived on UK: 09 Dec 2019
BRP expiry: 09 Sept 2022

I reached a part on the form where it's asking:

Has (husband's name) been previously married or in a civil partnership? YES
Does (husband's name) have any other children in the UK that are not applying on this application? YES. My husband got 2 children from ex-wife. The ex-wife lived in the UK as well.

Now, the form is asking me to provide a copy of the children's passport and birth certificate... As well as Evidence of where (the children's) other parent lives - such as utility bills.

We now have to ask the ex-wife for her utility bills. Here's the issue, the ex-wife is not cooperating, she's very adamant to provide the children's docs and utility bills.

ANyone else experienced this? Did I fill up the correct form? I didnt expect this. These were not asked when I applied for spouse visa before.

Provide the details you can as much as possible and anything outstanding should be addressed in cover letter and showing evidence of her refusal to cooperate where possible e.g. screen shots of mails , messages etc.

Same advice:

Hi. WHat I have with me are screenshots on WhatsApp where the ex-wife clearly said she cannot provide it. It's a series of messages with us asking the papers and she's replying back by asking what is it for. Finally she said she could not provide it. Even the children's passport, she initially sent us copies of expired one. We asked for the latest ones and it took here days to respond and sent us barely usable photos.

What's the court letter for in your case?

Anyone please if you have time to answer my questions please?

Date of Entry in UK: 9 Dec 2019
BRP expiry: 9 Sept 2022

1. English test. I took IELTS B1 on July 2019. I've read that I can use it again for visa extension (not just for ILR and citizenship), and the provider didn't withdraw it. I just want to double check this as it's only valid for 2 years?

2. Proof of cohabitation. On the span of 2.5 years (30th month this June), we have lived in 2 addresses. We spent 21 months on the first address, and 9 months on our latest address. There was no tenancy agreement, bills or council tax on our first address, so we have 0 correspondence with both of our names. Im aware I need to provide 6 docs each (total of 12 for both of us) from 3-4 sources. My questions are:

2.1 Are payslips and P60 considered? How about O2 phone bills?
2.2 Do I have to submit documents for both of us for at the same month each time? For example:

February 2020: Bank statement (wife), bank statement (husband)

June 2020: Bank statement (wife), bank statement (husband)

or can it look like this?

February 2020: Bank statement (wife), bank statement (husband), then

June 2020: Bank statement (husband)
July 2020: NI Letter (wife)

3. Proof of address of ex-wife. I have posted about this before. My husband has children with ex-wife. The form is asking for extensive details about these non-applying children. That includes proof of address of ex-wife which she made clear in a WhatsApp message she will not provide! (I have screenshot and will explain in cover letter, thanks AmazonianX). Does anyone know if anyone got rejected because of failure to provide this?
