Post by simomed » Wed Jul 27, 2005 7:29 pm

Hi all,
I am a non EU citizen, married to an EU citizen. Do I need a work permit to be able to work in the UK?
Thanks,

Your spouse? An EU citizen but presumably not British? (otherwise what follows is not correct)

Your spouse ... living and working in the UK? If so they are exercising their treaty rights and they do not need a Work Permit to do so. Under the treaty they have a right to work in the UK (or any other EEA country) without getting a Work Permit.

As a Family Member of an EU citizen (well actually EEA which includes a few more countries) you have the same rights. However you need an EEA Family Permit in your passport in order to prove it. Armed with that EEA Family Permit you do indeed have the right to live and work in the UK and without needing a Work Permit.

The good news is that the application fee for an EEA Family Permit is .. free! And easy to get. Just provide proof that your spouse is exercising their treaty rights and the Permit will be granted.

Example .... someone is married to an Irish citizen who is living and working in the UK ... the spouse lives in USA. Application for EEA Family Permit should be made at the nearest British Consulate in the USA.
