Indefinite leave to remain. No time limit

Post by Beyza525 » Thu Dec 20, 2018 9:59 pm

Hello guys I have a question if you’d help me I’d be so thankful. I came over here through my dads marriage, my stepmother and dad dealt with my home office stuff. My step mum was my legal guardian and we used to argue a lot she’d used to hit me and then she sent me back to my country ( turkey). last year in August the 1st I came back over here and at the border they took my ilr off of me gave me a paper saying about they suspended my ilr under the immigration act 1971. I was wondering if anyone knows what this was about? And also when I came back over here I didn’t live with my step mum and my address was still her address on the system I forgot to change it.

How long were you away from the UK??

ILR is not indefinite if you don't live and remain settled in the UK.

Why wait over a year before doing anything?
What exactly did the paper say? Were there any hints of what they expected you to do?
My guess is that if they suspended your ILR, then they expected you to contact the Home Office within a certain period to reinstate your ILR.

It said they suspended my ilr under the immigration act 1971 schedule 2 and no I tried contacting home office but they wasn’t helpful I couldn’t get through them and I contacted Stantsed they said home office has it they don’t keep stuff like that. And I spoke to a lawyer she adivsed me to apply for replacement as lost/stolen I have done that and now I’m waiting but should I worry?

Last year in June 5th I was sent back to my country by my stepmom and when I returned back to England in 1st August last year at the border they took my leave to remain, and gave me a paper saying about my detention and how it’s been suspended under the immigration act 1971 schedule 2 should I be worried? I don’t ‘now what that is and it said that they were going to inform me but my address hasn’t been changed at the airport I wrote down my stepmoms but I didn’t live with her since 1st August and I’ve been advised by a lawyer to send replacement as lost/stolen and write down that I haven’t been informed. So I’ve done that couple days ago. But I’m so worried

I don't think you should worry as worrying would affect your health but wouldn't affect your application.

You should be okay, if you were absent from the UK for less than two years or meet the exceptions to the two year rule.

One month and a bit is certainly less than two years.

Yeah they let me in when I was at the airport and since then I’ve been seen by doctors and started college and been to the police station a few times for something else and I’m pretty sure if I was “illegal” they would’ve deported me ages ago?x
