APPLICATION DATE BIOMETRICS VS ILR FEE INCREASE

Hello,

I am planning to submitting my ILR application(Tier 2 General Route). Could some experts kindly clarify the following queries? Your assistance is greatly appreciated.

1.Tier 2 Visa issued from date - 09/11/2018,First entered or landed to UK - 16/11/2018. Which among these two dates i should consider for calculating ILR application date?

2.Say if i consider my earliest ILR application eligible date is October 11 2023,I'm wondering if it's possible to create and pay for the application before the ILR fee increase on October 4th, and then complete the biometrics process after October 11th. Would this still be considered submitting the application within the qualifying period, or would it be rejected?

3. For the year 2020-2021, I was absent for approximately 113 days. I used my accrued paid holidays to visit my home country and worked remotely due to my country being placed on the red list. Do I need to provide any documentation to support this when filing my ILR application?

09/11/2018 is the start of your qualifying period for ILR.

Yes, fine to do that. No it won't be rejected.

You simply need a letter from your current employer stating your absences etc were approved.

Thank you so much for quick response. so the statement what they say "Your application may be refused if you apply earlier." in gov website is the date when we go for Biometrics ? is the any max allowed time between application creation date and Biometrics ?

Date of application is the date you submit and pay online and not the biometric appointment. This questions is answered so many times every day. As long as you are in your qualifying period when UKVI decides your application, you are fine. Your qualifying date you can apply from is 12th October, minimal from when you are eligible, just book appointment for after the 12th October.

You have 45 working days to enroll biometrics before the application is returned as invalid.

No that is not how the rules work: How to apply early and benefit from the date of the ILR decision ?

Thank Much CR001 and zimba. Struggling to understand at the moment i will go through again couple of times.

Can you please clarify my wife's case she is on PBS Dependent leave to remain.

From Date on passport sticker - 06/12/2018
First Arrived - 9/12/2018
BRP issue Date - 22/11/2018

Can i consider her qualifying date as 25/10/2023 ? i.e. BRP Issue Date: 22/11/2018 + 5 years -28 days and to avoid Fee Increase submit application on 3rd October and go for appointment on 26/10/2023?

Apologies if the questions are repetitive.
