My wife is on the 5 year route. I was under the impression she could apply for ILR "no more than 28 days before they have completed at least 60 months in the UK". That quote is from this document https://assets.publishing.service.gov.u ... 2.0ext.pdf.
(That document was found on this page: https://www.gov.uk/government/publicati ... ly-members)
However the immigration rules Appendix FM makes no mention of being able to apply up to 28 days before 60 months are completed (at least not that I have been able to find). Rather, they state:
Can anyone clarify this? I don't want to lose the application fee by applying too early, but I already prepared all the documentation and if we have to wait will have to go doing some of it over again to add the latest months of payslips, bank statements etc.E-ILRP.1.3. (1) Subject to sub-paragraph (2), the applicant must, at the date of application, have completed a continuous period of either:
(a) at least 60 months in the UK with:
(i) leave to enter granted on the basis of entry clearance as a partner granted under paragraph D-ECP.1.1.; or
(ii) limited leave to remain as a partner granted under paragraph D-LTRP.1.1.; or
(iii) a combination of (i) and (ii);
Many thanks.
