ILR Application - Absence over 180 days

Hi,

i am hoping someone will be able to help me with my query. My partner spouse visa is due to expire end of next month. Currently in process of doing the application.

My partner has been in the Uk for 5 years and will qualify for ILR. However, there is a slight complication to this, where there is an absence of over 180 days in last month 12 months.

This was due to serious post pregnancy complications, where a medical certificate can be gained from UK doctor, where they also prescribed medication . My wife travelled abroad , initially for 45 days and would return back to the UK. However, when abroad, the situation got worse, which resulted in 165 days being spent abroad. She eventually returned.

However, we had a second trip planned , pre booked beginning of last year, which in 21 days travel.

I would like to know, how would the 165 days be exempted. As this can be proved by UK hospital and GP letter.

There is no absence limit for sppuse visa holders.

The absence limit only applies to pbs dependent route visa holders.
