ILR application maintainance savings

Dear all,

I have applied as a dependant for Indefinite Leave to Remain together with my partner who is the main applicant and applied after 5 years in tier 2 general. In the application process I have uploaded all required documents according to the Guidance. Today I received a letter requiring sending some copies of documents including confirmation of maintenance savings of £630 for every dependant. Is this a new requirement for ILR?

How long have you been in the UK as a PBS Dependent?

What exactly does the letter state?

ILR does not have a maintenance fund requirement.

I have been in UK for 5 years. The letter says

I am writing in relation to the application you have submitted for leave to remain under Tier 2 Dependant Partner in the United Kingdom.
Unfortunately, due to the current circumstances surrounding COVID-19 and the latest government advice, for the safety of our customers and our staff, we have temporarily suspended the UKVCAS service locations where you would ordinarily take your documents to be scanned in support of your application along with submitting your biometric details.
We are keen for this disruption to have a minimal impact on our processing times and as such we are asking that you send us scanned copies of the following documents: -
Evidence of English language
Evidence of Life in the UK test results
A list of absences from the UK covering the past 5 years
Evidence of your relationship to your partner
A bank statement displaying at least £630.00 in savings over a 90 day period (the end date of which must be no earlier than 31 days before the date of your application).


I am fine with the top 4 requirements, but the £630.00 in savings over a 90 day period is not something I knew about before today.

Just to be clear, you and your spouse completed a single SET(O) form for both of you together, spouse as main applicant and you as dependent in the same form??

What was the initial start date of your Tier 2 Dependent visas and subsequent start date of extension?

There is no maintenance requirement for ILR. It appears that for some reason, HO is considering your application as a Tier 2 dependent extension.

Yes, both my spouse (the main applicant), I and 2 our children applied together in a single SET(O) application. Our initial Tier 2 dependent visas started in April 2015 (for 3 years) and were extended for another 3 years in April 2018.

In emails to my children, the HO also stated £630.00 in savings over a 90 day period requirements:

I am writing in relation to the application you have submitted for leave to remain under Tier 2 Dependant Child in the United Kingdom.

Unfortunately, due to the current circumstances surrounding COVID-19 and the latest government advice, for the safety of our customers and our staff, we have temporarily suspended the UKVCAS service locations where you would ordinarily take your documents to be scanned in support of your application along with submitting your biometric details.

We are keen for this disruption to have a minimal impact on our processing times and as such we are asking that you send us scanned copies of the following documents: -
The birth certificate for NAME
A bank statement displaying at least £630.00 in savings over a 90 day period (the end date of which must be no earlier than 31 days before the date of your application).

To the e-mail address WandSContingencyCaseworkDocumentReturn@homeoffice.gov.uk where we will be able to process your application to the next stage of our assessment which will minimise delays to your application caused by these extraordinary circumstances.

I suggest maybe respond to the email and advise that you have applied for ILR on Set(O) and not for a dependent visa extension and submit the documents excluding the maintenance fund requirement.

Did you have ANY absences from the UK since April 2018??

Yes, but only short term ones - up to two weeks and not more than 90 days in total

Thanks! That's reassuring. We definitely have not been away from the UK for more than 180 days in total for the whole of 5 years here.

Update: we have subsequently received an e-mail from the Home Office confirming that we do not need maintainance savings confirmation. We have then received our ILRs later in July. Thank you CR001!
