Overstay in 10 years ILR Application

Post by Puki61 » Wed Feb 20, 2019 3:50 pm

Dear All,

I have question regarding of the ILR application that I hope someone can answer my question.

In total I have 511 days travel absence in two type of VISA last 9 year 2 months , and my 10th year in JAN 2020 so within the limit still I guess.

Would the Home office may consider that I was in breach of my conditions during that visitor visa time , by residing in the UK for longer than would have been expected as the VISA allowed to stay 180 days based on the below information ?

Should I apply 10 year ILR under Tier 2 - ICT visa alone and wait 2 more years ?

If I apply for the ILR in 2020 JAN how likely the application would be rejected , would this cause any problem for next ILR application in 2021 ?

ILR Application - Visit Visa

Post by Puki61 » Tue Feb 26, 2019 9:22 am

Hi everyone,

I have question regarding of the ILR application that I hope someone can answer my question.

I have 511 days travel absence within two different type of VISA’s, and my 10th year in JAN 2020.

I have found that the first issued visit visa has duration on stay as 180 days while I been in UK more than expected and would like to clarify when could I apply for the ILR.

VISA details are below:

C TYPE VISIT VISA
Start date : 01.02.2010
Expire date : 01.02.2012
Duration on stay : 180 (on visa page)
First entry date : 07.02.2010
Last entry date : 11.03.2011
Days Outside of UK : 149 days
Days In the UK : 247 days

ENTRY WITH C TYPE VISIT VISA
Departed UK Arrived UK Full days absent
22/03/2011 11/04/2011 19 Return to UK with Tier 2 Visa
03/02/2011 11/03/2011 35
15/12/2010 20/12/2010 4
03/11/2010 23/11/2010 19
03/09/2010 13/09/2010 9
30/07/2010 23/08/2010 23
14/07/2010 26/07/2010 11
27/05/2010 07/06/2010 10
30/04/2010 10/05/2010 9
26/03/2010 06/04/2010 10
07/02/2010 FIRST ENTRY TO UK
TOTAL ABSENCE DAYS : 149 DAYS

TIER 2 INTRA-COMPANY VISA
Start date : 04.04.2011
Last expire date : 16.05.2019 - will renew 2 more year in April.
First entry : 11.04.2011

Year Full Day Absents
2019 10
2018 41
2017 43
2016 46
2015 43
2014 36
2013 51
2012 56
2011 36
TOTAL ABSENCE DAYS : 360 DAYS

GRAND TOTAL FOR BOTH VISAS : 511 DAYS

My questions are :

Would the Home office may consider that I was in breach of my conditions during that visitor period between 2010-2011 , by residing in the UK for longer than would have been expected as the VISA allowed to stay 180 days based on the below information ?

Should I apply 10 year ILR under Tier 2 - ICT visa alone and wait 2 more years or summer 2020 would be more safer option?

If I apply for the ILR in 2020 JAN how likely the application would be rejected , would this cause any problem for next ILR application ?

Many thanks

I responded to this earlier today in the other post. It will be more advisable for you to seek an extension on your present visa for 2 more years, with that CW will not bother to check your visa history before the commencement of your 10 years, that is any grant before 2011 when you got your tier2, then you will sail easily with 10 years LR. Bear in my that you need to be careful with travels in the next 2 years so you won’t exceed the 180 days threshold.

Many thanks Bizman for your advice , yes I consider this as the first year I had 150 days abroad my total days will now reduce to 360 days only if I count from 2011 onward , in my current position its not possible to get more than 40-50 days abroad as I only have 25 days allowance , so should not be any issue hopefully.
