ILR eligible date(Tier 2 short term + Long term + dependent)

Post by krishna_mani » Mon Jun 05, 2023 3:44 pm

Hi,

I would like to know some clarity on IRL eligibility. The answers to my case much appreciated.

May I know when I will be eligible for ILR under 10 years continuous residency, the below are the details

My first VISA approved from 10 June 2014 to 9 June 2015 under Tier 2 ICT short term but I came to UK only 10/Oct/2014(First entry)

Question 1) Date to apply for ILR can be calculated from Date of first Visa approval date 10 June 2014 or first entry to UK date 10/Oct/2014?

Left UK on 03/June/2015 ( before the visa expired) for visa process and returned to UK on 09/07/2015 in Long term ICT (35 days outside UK gap for Visa process)
Question 2) I am worried about the gap of 35 days for visa process and long term visa application made from India after short term visa expired. Will there be any issue on continuous residency? This 35 days gap allowed? Will my start of residency reset to 09/07/2015?

Went for holiday from 26/06/2019 to 08/07/2019 11 days outside UK
Went for holiday from 30/11/2019 15/12/2019 14 days outside UK

Now I am in my spouse skilled visa and valid till Aug 2025. I would like to know the earliest I can apply for ILR.

Thanks in advance.

You should use the first date of entry to the UK to count the 10 years. As you left with a valid visa and returned within 6 months your continuous residence remains unchanged

Thanks for your quick reply.
I was worried about this and thought that I had to make application within the valid visa period. Thanks a lot for clarifications.
so I can apply for ILR 28 days before 10th Oct 2014(First entry)

Thanks
