ILR qualifying period query

Post by pandaman77777 » Fri Nov 13, 2020 8:57 pm

I'm perhaps overthinking this, but saw people on Reddit saying they had a gap in the ILR period which seemed impossible.

My wife got first FLR in December 2015 (applied in the UK so entry date is the same), this was renewed 28 days early and granted.

The new expiry is in February 2021.

Does the time waiting for the visa (took a month to approve) count to the qualifying period? So, the 5 year period is satisfied in December 2020?

Or, do I have to calculate the 60 months period based on the start and end dates of each visa?

Thanks!

60 months from the date of entering/initial switching (Dec 2015) minus 28 days.

That's what I thought... Phew.

Just out of interest if an application for FLR extension took 3 months would the 2nd FLR have an expiry date 3 months after the 5 year ILR period?

Reason I ask is it seems the expiry date of the 2nd FLR isn't so important... My wife's is in February which would be past 60 months if we waited until then

Possibly but you can still apply after 60 months minus 28 days until the last day of expiry.
