Contact social services organisations that support victims of domestic abuse, I will suggest [REMOVED] they are good for providing support to domestic abuse victims in all matters

Has any male recently submitted ILR under DV after the visa was curtailed? If yes what documents they submitted and what was the outcome?

I know this thread is old, and I hope I get a reply from somebody.
I came to the UK on a skilled worker partner visa in Feb 2023 and I applied for DDVC and DV ILR at the same time after my IDVA insisted I should.... The DDVC was rejected on the grounds that my ex is not a British citizen or a settled person. But the Home Office still allowed me and my kids come for Biometric for the DVILR (with a fee waiver) and I submitted all the documents requested in the Document Checklist. My Biometric (1/12/23) and Documents submission online (3/12/23).... the home office sent me an email that they have received my application and documents and they will get back to me by 6th of May 2024.

I just want to ask if anyone has seen cases like mine and if they were successful (DV ILR approved for a skilled worker partner).

Thanks x.

You dont qualify for dv ilr on your current visa. The ukvi website is clear on eligibility. If your relationshio breaks down, ypu would be expected to either return to your home country or apply for a visa you qualify for, such as your own skilled worker visa.

https://www.gov.uk/indefinite-leave-to- ... ence-abuse
You can apply if your partner was one of the following:

a British citizen
a person settled in the UK (including as a refugee)
a member of the UK armed forces who has served for at least 4 years
Char (CR001 not Casa)
In life you cannot press the Backspace button!!

Thank you for your reply.

My IDVA and Citizens Advice thinks It's a 50/50 thing as the eligibility states as below:

Eligibility
You must prove:

-you have permission to stay in the UK - either a visa as someone’s partner or a Victim of Domestic Violence Concession
-your relationship broke down because of domestic violence or abuse from your partner or your partner’s family

And I was also wondering why the home office allowed me to do biometrics when they could have rejected both the ddvc and dv ilr at the same time.

I just wanted to see if there were people who got dv ilr under my kind of circumstance.

All applicants do Biometrics and UKVI only start looking at applications after Biometrics have been done.

There have been no reports on the forum of skilled worker dependenta applying for dv ilr, because the visa route does not qualify.

Hello there, unfortunately the person who replied to you was right, you can only apply for dv set if you are a partner to a British citizen or a settled person. If ddvc was rejected that clearly shows you that you don't qualify for the ILR dv as they have same eligibility criteria. So sorry for you darling.

All,

Has any male recently applied for the DV application? I applied in October and hasn't hear back anything from the Homeoffice. I also wanted to check whether letters from GP, therapists (referred by the GP) and charities supporting victim of DV are sufficient as a proof?

I came to UK in 2011 as a student and my visa was curtailed due to college closure, I renew 4 times with a new college all of my visas were refused due to one or another reason. I've been living with my current partner since 2015 I applied fir partner visa in 2018 it was refused another partner visa was refused while I was pregnant. I got my 1st ever visa renewal uk in 2021 after 2011 entry clearance as a student. Relationship was good at the beginning then his sister and mother started to cause trouble, disrespect me and he never took my side even knowing very well that's his mom and sister misbehaving with me. I was still being patient all these year since 2015 I was working for him as a florist work 3-5 days a week most of the time I didn't ask money as he look after rent bill food stuff. And i was working in another place so i had money. But I had to leave the job in 2018 as my visa status gooton worst and overstayer. I wanted to work after i got visa But he and his mum and sister didn't want me to work after I got my visa as my son was 2 years old that time. When I was a student I worked as a administrator got a decent salary. My child had some health conditions I'm still struggling. Since they didn't allow me to go work I ask my partner to pay some money for the work I do. But all the time he'll drag for 1 -2 weeks to give some money I have to ask, beg sometimes argument. If I want to send some money to mum he'll say girls don't need to look aftet parents. Then I start my own business from home while I help him with his business and running all household work. He always wants me to stop my business and focus on his business. He always says I'm gonna cancel your visa, I'm going to throw you out of the house. Any argument comes he'll throw my business stuff. After pregnancy I put on so much weight and he always says I'm fat. If I excerize he'll laugh, if I eat he'll say I'm eating a lot. If I put a nice make up and dressed up well he'll say lipstick too much look like a cartoon. Teaching my son . Your mum stupid don't listen her. Talk about how poor my family is and how small my parents house is in back home. Disrespect me it to the best. If he can't find the cloths he want when he just open the cupboard front of his eyes he'll throw all the clothes out. Always call me a stupid woman, an illiterate women so and so I can't keep telling. I had enough my visa ran out in November I had to beg for documents for weeks and weeks and I had enough I decided to walk out but no visa no accommodation with a 4 year old. I tried to get some support from my family hub since I have no visa I couldn't get support and they given domestic violence victim support contact details I said it's not domestic violence he never hits me then they said it's firm of domestic abuse, he controlling your finances your right to work and disrespect you in public. It's call financial and emotional abuse. All these time I lost all the friends . It's been only him , his business, his family I never exist but he's a good father. I caught him cheat me with his colleague twice. I still stayed as I have no other option.

So I explain everything ask for accommodation help. Then they directed to an agency who help with victims of DV. And they helped me with DDVC
Applied fir DDVC on 20th Jan, 27th Jan got granted DDVC applied for Universal Credit. Got accommodation through a DV refugee place a double room . It's more than enough for me.
Need to apply Set DV soon I don't know how it's going to work as it's emotional and financial that leaves no scars in a your body but affect your mental health very badly and you loose your self confidence and worth.

I don't want to go through courts and all cos I still love him and respect his that he was there with me when I had visa issues.
But if I continue to live with him and his family my life will be ruined so my child. There were so many occasions I really feel like kill my self, you are not allowed to work or run a business. You can't look after your parents. You can't choose the dress you want on top of all these visa issues. My dad passed away I have to look after my mum. I don't want to someone to controll my needs that way.
