Impact of new rule from 6th April 2010 on Work Permit holder

Post by ravib_10 » Sun Mar 21, 2010 3:02 pm

Hi,

I entered in the UK on 15th March 2007 on Work permit. I was on work permit till March 2009. Then Tier 2 (ICT) GOT Stamped for 1month. And immediately after that I got my TIER 1 (General) stamped with is valid till May 2012. I will be completing my 5years on March 2012.

My query is about new rules for Tier1 and Tier2 which will be implemented from 6th april 2010. One of the condition in that is that Tier 2 will not be considered for citizenship journey.
Does it mean only Tier 2 or will they include Work Permit holders also? Will I be impacted because of this?

Thanks

I don't think you need to worry at all, more so that you had your tier2 just for 1 month and before the start of a new policy. I think you should be fine to get your ILR by 2012.

Sorry Im confused what do you mean by Tier 2 will not be considered for any citizenship journey ?

What will happen with people already on old WP and Tier 2 ?

I think the OP refers to point 57 of the statement document
To reflect the temporary nature of Intra-Company Transfers, the Established Staff
category will not lead to settlement in the UK. As at present, an initial application
may be granted for up to a maximum of 3 years, with a possible extension for up to
a further 2 years. If the post is to become permanent, we expect employers to try to
recruit from the resident labour market.
This is only for ICT, not all WP and Tier 2. And point 58 clearly rules out any retrospectie effect.

Cheers.
