Thank u faysal for your reply, you are lucky to be contacted by your MP with in 8 days, I am still waiting for their response. My 10th month has already been started and looks like they have thrown my application in cold storage again. These days every thing is going very slow for me, if I order some thing online it take much more time than normal, My MP doesn't really bother to respond me. My application has been pending without mentioning of complex issues, there are other things that I can mention here about me is late. The words late and waiesare other name of mine. Even this frustration word doesn't justify the situation I am in. My wife FLRm is again late due to my ILR not yet decided.

Hello,
My 10 years are coming close. I need your valuable advice regarding ILR application. as my case is bit complicated and here it is:

Came to UK in 2007 on student visa valid till 31oct 2009

Tier 4 from 2009 till 2011 (did my degree)

PSW from 2012 till 2014 (in time application)

Applied for Tier 1 Entrepreneur in time application which was refused with appeal right on 23 apr 2014 but I did not go for appeal (As my partner had to leave country because of family commitments) instead, On may 20th I applied for Tier 4 general which was granted on 15th Apr 2015 till 01st June 2016.
Received a curtailment letter saying your leave curtailed so as to expire on 22nd Apr 2016.

On 21 Apr 2016 I submitted FLR (O) which was considered and received refusal on 26 Sept 2016 with no right of appeal.

On 15th Sept 2016 I submitted application for ILR on basis of long residence but home office received it on 04 Oct 2016 and i have got proof of postage for this application (dated 15th sept).

On 03rd march 2017 I varied my SET (LR) to FLR (LR) requesting them for my passport for Life in Uk test.

I received a refusal letter from home office for my SET(LR) dated 06th Feb 2017 received on 18th march 2017 (recorded delivery). I have written them a letter informing them about this with proof of postage.

Recently received biometrics letter from home office for SET (LR) and have enrolled for this. but no payment have been deducted till yet.

Now I will be applying for ILR on basis of 10 year long stay. How strong do you think my case is???
Any advice will be appreciated

Hi there,
Your case looks bit complicated, you may get a letter from HO for further checks in this situation no one can tell you how long it will take. I wasn't mean to make you sad.

Hi All,

I have a slight complication to getting to my 10 years. My 10 years is up on 27.09.17
Immigration history is staightforward until 30.06.17. I made an intime application on 30.06.17 but that was refused on 01.08.17 for maintenance funds wrongly calculated. I will put an AR 15.08.17. If i get a reply on AR likely negative within a week that is 22.08.17. Can i go to a PEO and apply on say 31.08.09, that is within 28 days of getting to the 10 years as i will have overstayed by 10 days which is within the 14 days allowed by para 39E. I will not have my passport which has been kept by HO.

Would be grateful to get advise on the above.

Since you know that the A will not be successful why go down that route? Why don't you make an early postal ilr be for the 14th day and obviously no decision will be made before 31st.

How important would it be to include other supporting documents (P60’s, bank statements, doctor’s notes etc.) if I have all original travel documents (passports, BRP’s and passport visas) that will be submitted with the ILR (LR) application? It says to provide these if I don’t have original travel documents which I do. If it’s deemed important, which documents do you think it’s most prudent to provide?

It is not required (and won't be looked at) if you have all the passports. Submit only what is asked for.

Dear eoo10 and other members,
There were few members waiting for ILR(LR) who received exceptionally complex circumstances letters from Home Office before completing six months waiting time and were given dates by Home Office of about end of July or mid-August to get there decisions. My question is that it is now about mid-August, does those members have received there decisions or any further update from Home Office. It is kindly requested to all the members with similar scenario to post their valuable views and updates. Thank you

Hi,
I have not received my decision and neither did I receive further correspondence. I'm patiently waiting and praying for the best. Someone on the forum did received decision well before the given date.

Salam, received email from HO, after questioner, asking for:

You have stated in tax questionnaire that you have amendments to your tax returns. Please provide the following:

HMRC tax assessment letters (re-calculations) – this is normally a covering letter which explains the additional tax required to pay and a single page statement that shows what was originally declared and what was amended.

Please send by 14 August.

I applied for entreprenure visa extension on 25 Feburary 2017 with husband as dependent then i varied application to FLR(FP) on 15 June 2017. i am completeing my completeing 10 years 28 August 2017.Now i would like vary my application from FLR(FP) to ILR Set(LR) on premium service.I paid premium visa fee and got booking date 02 September 2017.And i dont know what should i do with my dependent application.
Could you tell me how can i vary my for dependent application FLR FP/FLR M as i could not get same date for my husband on premium service what are possible options for my husband ? can i do it by post? Thanks

Hello,
I was after some urgent advice.
My wife came to the UK in March 2010 on a student visa.
She then had a spouse visa in 2013 extension was refused by UKVI in March 2016 which was appealed succesfully at the first tier tribunal in July 2017 the appeal was allowed on human rights Article 8 grounds.
Firstly we don't Know if she will be put on the ten year route from the five year route.
And most importantly in March 2020 she would have been in the UK for 10 years will she be able to apply for ILR on the basis of Long Residence or does she have to fulfill what ever visa she is given and will have to extend the visas accordingly?

Dear Forum


I am sad and confused now about my daughter’s application. Those of you following my story will remember that she applied a week before me in January this year and that I received a complex letter for her in July.

Well I contacted my MP to help find out what complexity her application has and they could not be given any reasonable reason.

A further correspondence from our MP came through yesterday as they had made further enquiry in to the case. And it was said that her application fell for refusal under FM so it was put on hold due to the Supreme Court Judgement regarding Immigration Rules for the minimum income threshold for non-European Economic Area (EEA partners and non-EEA dependent children. In fact let me just quote them directly here.

“Following the judgment on 22 February, we paused decision-making on some applications under Appendix FM to the Immigration Rules so that the implications of the judgment could be considered. It was necessary for us to pause the processing of some applications in order to ensure that we acted lawfully while we considered the implications of the Supreme Court judgment. Only cases falling for refusal because they did not meet the minimum income requirement or falling for refusal and involving a child have been paused. All other cases have been decided as normal. The Immigration Rules were changed on 10 August to reflect this ruling and her case is in a queue of cases awaiting consideration. We are unable to estimate how long it will take to consider the paused applications as it will depend on the individual circumstances of each case.”

This is clearly a mixed-up. I cannot explain how an ILR under 10 years’ long residence route is being considered under FM. The fees for these applications are different and so are there application forms.

I have replied back to my MP explaining this and the office is making further enquiry base on the explanations I gave them.

Anyone has any idea how else I can resolve this or have been in a similar situation before?
