Set O for child

Hi All,

I and my wife got the ILR through the global talent route using the Set O form. Now I want to apply ILR for my child who is under 5 years.

Can I use the Set O form again for his application or there is any other application form?

Where was the child born?

Why did you not add the child to your and wife's application?

Hi,

My child was born in India and he has spend 4 years in the UK. I did not apply for his ILR with my wife's ILR because my wife was away for more that 180 days due to medical reasons. Now she got the ILR and what I understand if both parents have the ILR then child can also apply for the ILR irrespective of country of birth?

Please suggest if I can apply for ILR and I can use set O.

SET(O) is correct. However, the child could have been included in the mother's application. Not sure why you did not do this.

Thanks for your response.
I have not included my child in my wife ILR application because I was not sure if she will get an ILR due to her absence for more than 180 days. Also, I came to know that if child is not born in the UK then both parents must have ILR to apply child's ILR if child has not spent 5 years in the UK.

I have a further question on set O, I was on Global Talent visa and got an ILR. Now for my child's ILR should I select Global Talent Dependent option or any other option?

Both of those assumptions are incorrect. Children do NOT have any minimum residence requirement for ILR. Hence there are no absence limits either. They simply get ILR when both parents are either settled or eligible to be granted ILR at the same time as them
