Hello,
I need a quick help I am living in UK on a Spouse visa on first extension for two and half year. My current duration will expires in April 2016 and because of the restriction that you can only apply for new extension 28 days before.
I want to know how long before I am OK to travel i.e.. few weeks before etc. I am planning to go abroad in March and come back in the start of April. Will this be ok?
Could any one please shed some light on how long before I am OK to travel and come back.
Regards
Muhammad

What date will leave and then you return to the UK and on what date does your visa expire?

Yes as long as you enter before your current visa's expiry date.

What is your visa start date and on what date did you enter the UK? Is your visa valid for 33 months?

Hello CR001
Yes I got the spouse Visa in 2013 for 30 months which will expire on 30th of Aril 2016. And I need to apply for another 30 months in April 2016.
Now problem is my sister's wedding is on 2nd of Aril and I need to go home before this date and come back on 13th of April.
Will this be ok so I am coming back few weeks before my visa expires?

Did you apply within the UK or from abroad?

Should be fine to apply for extension when you return and before your current visa expires.
Are you applying by post or in person?

Well I was going to do in person before I go abroad but as they
Only allow before 28 days. So I was going to apply normal but I am getting your point should I apply in person when I come back?

You can apply sooner than 28 days but it will create a shortfall for ILR and you will have to apply for another extension in a couple of years time to cover a very short period. How long have you been in the UK and under what visa categories??
Book your in person appointment before you go on holiday for a date when you are back and carry the booking confirmation and proof of payment with you in case you are asked anything when you return.

Oh yes that's a great idea.
Basically in October 2016 I can apply for ILR under 10 years system. It will be 10 years in October 2016.
So you think I can book and go in person more than 28 days and sort it out?

I am sure you can do it before you travel and provide the explanation etc on why you are applying early. You need to make sure that you allow enough time for your BRP Card to be delivered before you travel.
Otherwise might just be easier to do it as soon as you return and follow my suggestion of docs to carry with you as proof of appointment.

I don't know the numbers of the contact centre but they will tell you to apply no sooner than 28 days before expiry.
BRP card = biometric residence permit. You must have received one of these when you applied in country for your spouse visa. You can't travel back into the country if you don't have the new one if you apply before you travel.
