High Court confirms holders of Stamp 4 permission can be granted an Employment Permit

Justice has confirmed the Department of Business, Enterprise and Innovation ('the DBEI') was wrong to refuse an employment permit to an applicant who held a Stamp 4 (long term residence permission).

What does this mean? Why would anyone need work permit while holding Stamp 4?

A lot of people who get their Stamp 4 or 4EUFAM based on marriage to an EU person would benefit from this, if their relationship breaks up.

What about those who are on temperary stamp 4 from EU treaty review, stamp revoked based on alleged marriage of convenience, can they apply for work permit? Will there be any issues?

Based on this judgment, you can apply for an employment permit if you have a *valid* stamp 4.

Employment permits cannot be processed if you don’t have a valid leave to remain in Ireland.

No. Nobody can operate a business under employment permits.

You said you wanted to run a business. That’s not allowed under an employment permit. You must be employed as a PAYE employee in order to apply for an employment permit.

Hi Littler ,
My query was if someone's EU treaty rights revoked and then on temperary stamp 4 from EU treaty review department. can that person apply for work permit if department has some concerns regarding marriage?

Sorry didn’t notice the username. As I said before, if you have a valid stamp at the moment, you can apply for a work permit. It doesn’t matter if that stamp is temporary or not.

If someone manage to obtain work permit, when it comes to GNIB registration, Will EU treaty right will creat an issue at that stage given the case is still with EU treaty review department

I have question which I asked 2 solicitors and non of them answer.. may be I'll get some reply here..

Background: I applied retention EU5 and it was refused, then I put review for the decision. while they are reviewing they grant me Temp Stamp 4...

Assume If I apply for work permit and it get approve.. Now do I have to withdraw my retention review application? and What will happened to my citizen application??

Assume if I apply for work permit and it get approve.. will my previous 5 years on Stamp4EUFAM and Stamp4 will be reckonable OR not??

@littleer I do my research before posting here, I already read this 17 pages document couple of times in last 2 to 3 days. I didn't find answer of my question, I also mentioned that I bring this question to 2 solicitors and they weren't able to answer. excuse what they gave was sorry we didn't read the complete judgement.

so that's why I request to hear your thoughts.

Regardless of EU stamp for 5 years counts for citizenship application or not.

But main question is if we manage to get work permit, when it comes to GNIB registration, will EU treaty right department create issue at that stage ?

Whether you want to withdraw your retention review application is not a concern for this matter. The judgment merely said that it is wrong for DBEI to refuse to issue a work permit for a person who has a stamp that doesn’t require an EP but is about to lose this stamp.

It sounds like you are in the same boat, so if all things stand (if INIS doesn’t appeal the decision), then you will be able to apply for an EP. Once you obtain your EP and apply for your Stamp 1 based on your EP, it is between you and the EU Treaty rights department whether you want to pursue further on your review application and whether they want to continue reviewing the matter.

Citizenship is another completely independent matter. The rule is very clear. You need to have five years of reckonable residence. Having a marriage breakdown does not void your previous stamps and they would still be valid. However, if INIS thinks the marriage is a marriage of convenience and they issued you an intention to cancel your previous permissions, that’s when they won’t be counted as reckonable residence.

thanks @littlerr .. that completely make sense.

it's very unfortunate that I was preparing for EP and just today I have received letter. that my EU5 review application is refused.. where they mentioned my temp stamp4 which was valid till july2021 is not valid anymore and they suggest me to fill the EU4 form in 21 days. so I believe this option is close for me at this stage..

I'm curious to know how EU4 work?? what will be the status after EU4 submission? what will be the outcome of it?? it's stupid question to ask but can I still apply work Permit OR should I request them to grant me temp stamp1 so I can switch to EP completely??

Oh I’m sorry to hear that. That is a very bad news.

EU4 is just basically an application for INIS to review their previous decision. You might want to have an immigration solicitor to arrange all the evidences properly for you.

It is completely up to INIS to decide whether they want to give you a temporary Stamp 4 when the review is in progress. I don’t believe they would issue temporary permission without a good reason though.

thanks @littlerr your suggestion means alot as I'm blank now.

what other options I can try? should I ask minister to grant temp? I know its early OR should I send request to repatriation department? OR should I use my last card, leave the country and apply EP from outside of Ireland BUT again EP applications outside ireland are closed due to COVID?

I already request them to grant me temp stamp1 so I can apply for EP, but department didn't allow me.. I also sent an email to Enterprise Department to allow me to move from Stamp4 to EP but they said its not as per inis.. its just week ago, a guy won the case that stamp4 can apply for EP.

they close my application and mentioned my current temp stamp4 is not valid anymore.
I can apply if they let me allow.

You would need to cite the recent case to DBEI and ask them to reconsider your case. Again, you may want to get an immigration solicitor to properly construct your arguments, either to DBEI or to INIS.
