EU1 application made - what happens next?

EU1 application made - what happens next?

On Monday, I sent off the EU1 applications for my parents who are in Ireland on a visit visa which expires on 3rd February 2019.

What to expect next? From reading the related forums here, I have gathered this is what happens next -

Receive acknowledgement letter: 4-5 days
Receive letter granting Temp Stamp 4: approx. 8 weeks
Receive decision on the EU1 applications: approx. 6 months

Am I correct in this?

Regarding the above:

At what point do my parents register with the Garda National Immigration Bureau (GNIB)?
Will the receipt of an acknowledgement letter suffice, as they will reach the 90 days threshold in Ireland by mid-March?
Will they need to go back to the Garda National Immigration Bureau (GNIB) if/when Temp Stamp 4 is granted?

Please advise. I am unable to find official guidance anywhere.

Unless INIS has tripled their case workers then you’re in for a surprise. It’ll easily take a minimum of 1 to 1 & half years for a final decision on your parents’ EU1 decision to be reached.

Acknowledgment letter isn’t sufficient for a Stamp 4

INIS will write to you advising when to go to register parents for Stamp 4 at your local Garda station. Make sure You the EU Citizen bring your passport and be present with your parents otherwise they’ll refuse to register them at the Garda station.

Whilst your parents’ case is pending a final decision they are legally allowed to remain in the state with the same rights of a general visitor. They cannot enjoy the same rights as the EU Citizen until a decision is reached.

If for any reason your parents need to travel back home whilst the EU1 decision is being reached they can do so. In this instance you MUST apply for a Re-Entry visa to make sure they are allowed in the country when they fly back.

its 4 weeks to get temp stamp4 but if u apply on eu1 for parents that could be difficult, they dont like this cases, spouse and children of eu citizen is easy, parents and sister/brother must be really dependent on the eu citizen with loads of proof,

they will get 9 months allowance to stay in Ireland


it possible that they wont get stamp4 at all, but a general allowance to stay, usually takes 9 months for final decision,

sometimes it takes more than 9 month for final decision, if they get stamp 4 in the beginning than they can renew that, but if they did not get , than even after 9 months they wont get it either, so it means they cannot work, which should be expected anyway if ur case is built on dependency, that kinda assumes that they cant really work

normally spouse of eu citizen gets the stamp 4 after 4 weeks, but parent of eu citizen not so sure they get it at all, and eventually if ur parents are accepted should be considered a lucky case.

Hi,

I am not disputing with above comment however what i have experience is wee bit different.

I have applied for parent EU1 visa....got a letter from visa office within 3 weeks to obtain temporary stamp 4 for 6 months from the date of application with right to work........

I have also read other people threads with similar information so not sure why dependent parents would not get right to work (even if they will not be working in most of the cases anyway)

Dependency for the purpose of EU1 doesn’t mean parent has to be incapacitated and unable to take up employment.

It means you have to prove dependency of parent on you because the standards of living (even if the parent works back home) are not sufficient for them to survive on. In many of the developing countries average wages will barely cover basic living costs let alone if your parent(s) need medical treatment, GP visits, shoulder gas or electric bills etc. Their financial burden can be further compounded by lack of savings or other income the parent may or may not have available to them.

My parent was granted the EU1 almost 2 years ago and the process at that time from the moment we applied to getting the EUFAM took 1 year in total. The longest period being the final decision as Stamp 4 was given very quickly.

Are you still in Ireland or moved back to the UK? If you have moved to the UK what reason have you shown for moving back to the UK?

Still in Ireland and no plans of moving back to the UK either for the immediate future with Brexit looming over.

Received refusal for my parents' applications today. There is the option for Reviews.

The reason for refusal given is that they are not satisfied that my parents are dependent on me. Nothing else to say why they believe this is the case.

I had provided bank statements showing money transfer from the UK to my parents' joint account in India over 18 months before moving to Ireland. There is documentation for financial support from before then but did not submit with the EU1 applications.
I had submitted a statement of their monthly expenses in India and copies of their bank receipts to show that their pensions are inadequate and that I have to top it up to meet their basic needs.
I had provided my Irish bank statements and medical receipts in my parents' names in Ireland to prove that I pay for their expenses in Ireland too.
They have been living in the same household as me since they arrived in Ireland in November 2018 on a Visit Visa. The Visit Visa in itself had been applied on the basis that my parents are dependent on me.

How else can I prove dependence?

Are the chances of a review succeeding better with legal/solicitor representation? Or do I go it on my own?

There had been a decision in the UK Immigration Tribunal that my parents were not dependent on me because they had some savings to their name at the time. These savings were wiped out a few years ago due to a natural calamity in India. I had provided evidence for all of this as part of the EU1 application. Do you think, maybe, they are using this judgement from 2012 now against us?

Also, the refusal letters are dated 18th July but were only received today. We have in effect lost 3 working days out of the 15 days within which to submit the Review applications. One specialist immigration solicitor in Dublin I called cannot give me an appointment before 8th August. Desperate!

Any insights gratefully received.
