Judicial Review Letter & Response

Post by cobh_18 » Mon Jun 21, 2021 12:10 pm

I appointed a solicitor to go for JR and below is the response I received from Citizenship Dept. Anybody else had this scenario? What to do here?
Your client’s application for naturalisation is being prepared for submission to the minister. I expect that your client’s case will be submitted to the Minister for decision within a period of 12 weeks. Please be assured that we will revert immediately once a decision has been reached on the application. Your patience in this matter is appreciated.

We note your threat to issue Judicial Review proceedings unless a satisfactory response to your letter is received. We trust that upon consideration of the information provided that your client will not issue judicial review proceedings.
I applied in Aug, 2018 based on Refugee Status. I received this letter this month from them.

Hi cobh_18

I think some people on this forum had similar responses but they never got their citizenship decision within 12 weeks.
I applied to JR too, I am awaiting a response from them. IF they come back to with same response I will decline it as I am waiting for 4 years for a decision
12 weeks time is ridicouls.

Can I ask you whhen did you apply?

I applied in Aug, 2018, and my application moved to second stage in January 2019.

Did your solicitor send a notice to DOJ ?

And for how many days?

When did you get this response ?

Did DOJ asked you NOT go for JR ?

I'm sure what I'm asking
I think you need to understand this matter.

First stage
Normally solicitor sending a notice Department Citizenship delay matter etc give us response in 14 days or 21 day depend.

Second stage
Department given response thye will issue decision in certain time like above

Third stage
some time they don't give any responsed
and person need to through JR
You can't get straight way decision through JR
I hope you can sleep well.

So what I'm asking

Did he gets response on initial notice
Or through JR ?

So to answer your question. This response I received after my solicitor sent the first notice. However, my concern is, i have seen many people receive the 12 week reply from The immigration Dept. And even after those 12 weeks are over they didnt receive a reply.

So most of Cases they respond in 12 week with decision but if you unlucky they didn't respond in 12 weeks so you open Door for JR ,

In JR proceding they can't asked you further time because you already gave them so finger cross.
Look like to me you will get decision soon.

I know most recently case
1 - Same like you on initial notice they asked to make decision in 12 weeks even this person applied in 2017.

Yeah, it looks like this is the only solution. It’s better to do it bland soon as you can instead of waiting and giving them extra time.

Wow, amazing news @Statusquo73. I guess that’s the only way for now unless they don’t start working faster.
